有没有朋友有类似的经历?
我现在学校做postdoc,持有cap-exempt的H1B,有效至今年8月31日。半个月前拿到一个
公司的offer,公司希望我9月1日就开始上班。我第一次申请cap-subject的H1B,
公司律师说2007年有一个什么memo,即使有cap,10月1日之前也能合法工作。
因为我现在的H1B 8月31日到期,律师递交了两份申请:
一份是H1B extension, 将我现在的H1B延长到9月30日;
一份是H1B transfer, 将我的H1B的sponsor转到新的公司,9月1日开始。
各位觉得靠谱吗? USCIS批准的可能性大吗?
要是USCIS只能准许10月1日开始新的cap-subject H1B的话,那我9月份是不是就
只能回国签证去了? 多谢!
这是我从网上找的一个类似的case:
Question 7: A Ph.D. student began her first H-1B employment in August 2009,
working as a postdoctoral associate at a university, which is a cap-exempt
employment. She has been offered a job in March 2010 at a pharmaceutical
company, which is cap-subject. Does she have to wait until October to start
the new job?
Answer: The USCIS has issued a favorable opinion letter date May 23, 2007,
regarding the ability of an individual in H-1B status through a cap-exempt
employer to work for a cap-subject employer after the filing of the
cap-subject H-1B petition. The exact language of AC 21 permits the
beneficiary who has already been issued an H-1B visa or was in H-1B status
to accept new employment upon the filing of a new H-1B petition. It does
not reference the need for the start date to be immediate or put any other
limitations in place. Based on a literal reading of the law or statute,
the argument is that a person shall be saveable to start employment upon
the filing of the cap-subject case, even if the start date of the H-1B
petition is months away. The USCIS opinion letter concludes that the
portability provisions do not confer H-1B status to the individual.
Rather, the USCIS gave a narrower benefit of continued employment
authorization. According to the USCIS, the individual would be permitted
to continue to work if he is covered by a valid labor condition application
(LCA), filed by the pharmaceutical company during the entire period from
April 1, 2010 to October 1, 2010. However, if the second H-1B petition
is adjudicated before October 1, 2010, the beneficiary shall cease
working until October 1, 2010.

隧他叫手下把我叫过去聊聊,跟手下聊了一半以找不到manager为由,请走。。。
前两天那位,面L面一半被请回的,相逢何必曾相识。。。

悲催的是,准备了半年的coding interview, 这些coding 的题也都答出个70%~90%,
还是没有走上是s/w engineer这条路。
最后面试这个position的时候,虽然也是编程的位置,但一个coding的问题也没问,就叫来聊了一天。 |
