(1)有没有这回事 (2)当时她是不是还没过16岁 (3)当时他是不是已经过了16岁

intelligent enough to know that it's awfully hard to prove that the CP pic/
gif/video has been residing in your account "unknowingly" all these times.
What, you just gonna somehow convince the court that the file has never been
accessed and viewed by you? That's your defense?
Pretty much if they find it in you, it's over. Let's talk plea bargain.
Have you ever seen a case in which PC materials were found in an adult's
possession, but he was found NOT guilty because they were "unknowing" to him
? Have you ever read about a case with such an outcome?
Me, neither.

beyond a reasonable doubt, how the defense would affirmatively defend
himself. Usually if such elements exist, the prosecutor wouldn't be able to
make the case.
