due to the following:
Denial Reason;
Neither the earliest date listed for a recruitment step on ETA Form 9089,
February 1, 2014 listed in 1.15, nor the date the application was filed July
16, 2014 fall within the Prevailing Wage Determination validity period of
February , 2014 to June 30, 2014. This indicates the employer did not begin
recruitment, nor file the application during the Prevailing Wage

感觉USCIS这个理由有问题啊。
PWD是2/2014 - 6/2014， 你广告在2/2014开始，最后7/16/2014递交PERM 9089,说明
recruitment最晚在6/16/2014就结束了，然后cooling down at least 30 days,然后交
PERM 9089,可能是我知识不够，反正我没看出上面的TIMELINE有任何问题。
刚刚google了一下，发现你可能很不走运，你没列出PWD的开始日期到底是几号，我猜
测是2/2/2014以后，这样拒绝你就合理了。
你让律师把9089 form上那个I recruitement发给你看看，看看什么广告是在PWD以后开
始的，之前的广告重新做一下，或许能避免重做一些广告，然后再交PERM，或者file
motion to reconsideration,不知道哪个时间更快，问问其他律师。

发帖数: 853 | 4 律师说基本上只能重新弄了，我老板挺火大的要求换律师，并且要现在雇的律师赔钱。
我的是挂在公司网站上的广告打早了。
在公司网站的广告是2月1号开始
我的prevailing wage是2月6号到6月30号。 如果file的时候稍微注意下在公司网站上
重新打一下就行了。
再就是另一个理由我理解就是30天的cooling down要包含在pervailing wage里面，
因为理由里面另一个原因就是我的priority date是7月16号 而我的prevailing wage那
个时候到期了。

刚刚上网查了一下，好像2个条件满足一个就可以：
1. 在PWD 开始日期后，run first ad
2. 在PWD结束日期前， file PERM petition.
有没有过来人确定一下。 | m******p

个case对那个申请人都是多么重要。好在lz的老板很向着你，这样就不怕，总能想到办

2） 我之前问我们的律师，他说prevailing wage 的时候，不想做招聘，等完了之后
再做，在他给的summary 里面 他这样写的：“With a prevailing wage in place,
we proceed through a 30 day advertising period”
不知道上面是不是有问题。也不知道为啥，去年就讨论完了job description,现在还不
提交ＰＷＤ，难道是等招聘旺季。 ｄａｎｇ．．．只能问候律师的父母了。

拿到了PWRD再招聘没问题

而且你广告后这么久才递交PERM，太冒险了点吧 |
