Do they know it takes 3 months to get H1 approval? Is it their real
intention to wait that long, or they have a lawyer unfimiliar with
immigration laws?
But for you, once the H1 transfer is filed before lay-off, you are fine
whether working or not working for new employer during H1 pending. |

发帖数: 194 | 7 As far as I know, the old intepretation is that after your attorney sends
out the H1B transfer application, you can go work for the new company. I
also did that many years ago without any trouble.
Nowadays, this has been changed to be more strict and clear. Many new
companies and their attroneys only take the starting date after affirmative
approval notice.
However I think you don't need to worry too much about it, because: 1. you
can do the un-paid vacation before transfer to new company. The immigration
officer won't challenge too much on couple of weeks' window as long as you
have affirmative new job offer (keep the official offer letter all the time)
.
2. confer with your current company to cut the last paycheck the later the
better. Even in some small companies,you can go back to the previous company
to ask them to cover your transient month paycheck by either put the last
payment(s) later, or any other solutions that both of you agree.
3. if the transient window is too much, like several months, tell your new
company that change the process to premium. The worst case, you can pay the
premium fee out of your own pocket. But believe me, many companies would do
that themselves unless it is really a iron-cock. |
