This is a lot of noise about something that isn't likely to happen soon, but
if it does won't have much of an effect on most H4s. This is a notice from
the DHS semiannual regulatory agenda. Each agency is required to publish a
list of rule changes that they are thinking about. Publication on this list
does not mean that the agency is going to follow through with a rule, only
that they are thinking about it. There are things that have appeared on the
DHS regulatory agenda for years without any action ever being taken. At best
, this is the first step on a very long road. The next step is a notice of
proposed rulemaking. This takes a very long time to clear through the Office
of Management and Budget. Notice how few rules the USCIS has actually
published? We still don't have regulations for the AC21 legislation signed
into law by President Clinton. Worse, we still don't have rules for the 1991
NIW legislation. That's 21 years without regulations! Don't hold your
breath waiting for them to get around to publishing this rule.
If they do, however, it won't benefit that many people. It will only apply
to H4 dependents of H1B principals who are in post-sixth year situations. No
other H4s will be eligible.
This is a lot of noise about nothing. |

涂选择了EB3,现在H1B已经第七年了,还在等,家里领导本来也是H1B,没办法和公司
就绿卡申请达成协议,再加上公司效益不好,最近被layoff了,现在他的H1B已经离6年
期不远了,很难再找工作,如果有这个H4的EAD,就容易很多。之前我们工作都还算稳
定,压根没想过会转H4的,现在就被卡在这里了。其实,我想,这个EAD对大部分EB3C
都有潜在的好处,如果EB2C排期很长,也会有好处,至少给spouse明确的盼头。 |
