四月renew 了一次H-1B。之后找了新工作，离开时renew后的H-1B还有半年多才过期。
换了工作以后，新的单位重新申请了新的H-1B。本以为一切都顺理成章。谁知今天才知
道，我离开原单位后5个月，原单位把我的H-1申请给revoke了。USCIS以此为借口，说
我从2008年4月开始就已失去H-1B身份，进而要deny我的申请。我已和律师联系，希望
一切顺利。
同时，有几点体会和大家分享：
1 不要轻易做SR，我于11月14日做了SR，当天他们就发出了NOID。
2 看来拿到绿卡之前，保持H-1B身份可能更为保险。

I mean keep H-1B (don't use EAD) after file 485 if possible. I was asked to
supply evidence that I kept on working with H-1 after file 485. Just in case
you have bad luck as me.

they tried to deny your 485 on the basis working without authorization for
more than 180 days.
Did you apply for EAD and kept it renewed (always having valid EAD since
2008)?

发帖数: 3042 | 27 On the one hand, your lawyer was correct that this is a wrong NOID because
you never fell out of status.
On the other hand, had you used EAD, you won't have this issue at the first
place because your authorized stay was granted by AOS and your work
authorization was taken care of by EAD. The whole 'maintain H1B status'
would have been totally irrelevant.
Anyway, congratulations on the final approval!
