were paroled into the U.S. on 07/10/2009 you were no longer in H1B status.
On 09/15/2010, you were again issued H1B status. Therefore, it appears that
you were out of status from 07/10/2009 until 09/15/2010.”
这可能是一个很严重的问题，out of status 超过180天了！！！
现在说明一下案子具体情况，当事人在美国始终在一家公司工作，H1B签证是连续的，
没有中断过，尝试过三次绿卡（EB-1B,PERM,EB-1A）申请，以下为签证记录：
10/01/2006-09/30/2007,H-1B来美
10/01/2007-09/14/2010, H-1B更新
12/01/2008, 递交EB1B (i-140/i-485)
06/26/2009，离境
07/10/2009，返美证入境（没有用EAD)
09/22/2009，EB1B i-140被拒
09/30/2009，EB1B i-485被拒
09/15/2010-09/30/2012, H-1B更新
12/01/2010，递交PERM i-140
07/21/2011，PERM i-140批准，等待排期
10/01/2012-09/30/2015，H-1B更新
12/01/2012，递交EB1A i-140
07/19/2013，EB1A i-140批准
08/09/2013，递交EB-1A i-485
10/22/2013，收到EB-1A i-485 Intent to Deny Notice
咨询了几位律师，说法不一，当事人已经作了最坏的打算。现在乞求各位大佬援手相助

主要的问题是
EB1B 485's deny 导致 invalid AP parole till 09/15/2010
黑色地带是期间你依然为原公司工作，
这个工作身份不可能是Parole, 如果没有使用EAD, 只能是H1B
不知道在法律上的事实上存在的专有术语

由于你out of status 180天以上的事情发生在3年前，可能不会影响签证申请和入境。

，而是算parole。但原有的H身份还能继续extend，也能transfer，算是一个规则中的
例外。

始就算 out of status。你先前可以通过申请 H-1B 签证来避免使用 AP。至于被拒的
风险有多大，只能你自己权衡。
当然如果你的 H-1B petition 一直有效貌似无所谓，这是个移民法的 gray area。楼
主的 petition 在 2009 年 4 月就过期了，然后貌似 renew 了，但可能 extension
没批下来就离境了，视同放弃。7 月又用了 AP 入境，相当于在美国没有合法身份。

应该是从你收到被拒的时候，你的AP/EAD就无效了。因为它们是基于你的I-485Pending

实你应该告知雇主你已经是AOS了，不再是H1B。
如果I-485被拒，你应该立刻Reinstall你以前的H1B （如果还有剩余时间的话）。这样
你就又是H1B身份了。不Reinstall的话，你就无身份了。 |

There is a Board of Immigration Appeals case from the 1970's that is still
good law. It stands for the principle that an extension of the same visa
status is the government's endorsement that your status is and has been
lawful. The USCIS always has discretion to approve an extension of
nonimmigrant status, and if they exercise it, then it has the effect of
endorsing your continuous lawful status-- in other words, your nonimmigrant
status becomes unbroken again.

发帖数: 2769 | 19 你这个case可能不适用。主动离境之后相当于放弃了上次的status，下次入境时候CBP
有权不让你进来（例如，离境期间做了使你不能再被允许入境的事）。而持签证入境才
能申请admission，持AP入境不算admission，只算parole。

7月10号用了AP，那么H1B身份就失效了。
如果要继续工作，应该使用EAD。
在2009年9月30号485被拒掉后，EAD也就失效了，应该立刻重新申请H1B
但是楼主还用H1B工作一直到2010年9月15日extend H1B
所以归根结底只要用了AP，H1B就失效了

从你这个case来看不是这样子的。
除非移民局搞错了
