再回头想想我的5次拒签，耽误两年，重新考托考G, 一个年轻有为帅气逼人的青年，活
活被熬成了一个蹉跎的码农。

网上抄了一段：
In a recent liaison meeting with attorneys of the American Immigration
Lawyers Association (AILA) the California Service Center (CSC) recently
announced its intention to follow the latter interpretation. The head of
the Residence Product Division of the CSC has agreed to the following:
If an I-140 is pending at the time that the company changes, according to
the CSC, "no action is required" until the completion of the I-140 stage.
Evidence of the "bona fides" of the Successor should be submitted at the
time of filing the I-485 application
The CSC will allow applicants to supplement the file on an existing I-485 by
submitting evidence of the "bona fides" of the Successor that shows that
the same position and compensation, etc. are still offered. The CSC has
confirmed will not require re-filing of the I-140 or the I-485.
In order to avoid having such evidence routed through the correspondence
process, the attorney should clearly establish on the cover letter that
attached documents are for consideration in connection with a pending I-485
application, based on CSC/AILA concurrence and make clear reference to the I
-485 Receipt number.

If you file EB1, you can submit 140 and 485 at the same time.
The good news is that it won't backdate easily and 485 will be approved
in 2-3 months after submition.
Best idea is to get premium 140/140 SII and prepare the health interview.

律师说不能加急，因为LC是和以前的140挂钩的，加急必须original LC和140一起申请。
而且485申请也必须等140 approve后才能递。因为只有140 SII approve了才能和以前
的priority date挂钩。
今年是没戏了。我该跳槽就跳吧。

LD的情况有点不同，公司交I-140的时候换了律师，把eb2的办成了eb3，我们也刚刚发
现问题。现在不知道律师是写封AMEND的信还是重新交一份I-140（只能得到很少的信息
）。如果是重新交了I-140能不能仅凭收据就交485（排期有可能9月份到.或者说，新的
I-140收据上会不会有PD,还是要等到I-140批了以后才会有PD relink？
新的I-140应该不会有PERM原件伴随，不知道能不能办加急？

LD's company lawyer is too hard to reach and too slow to move (even for the
mistake they made). Need to fight hard to get the copy of receipt and
underlying new I-140 form (if filed in time).

既然没有换雇主，就没有pd relink的问题，所以不用等140 amendment approval才

把律师爆骂了一顿。他说明天之前要么给我准备好I-140，要么回复不用file I-140SII
的authority。（除了grandfather rule 我也想不到其他什么可能的原因）
PP以及和485同时递交的问题今天也问了。明天有了答案发来给你们参考。这次我肯定
要他给能与不能的authority，不再相信他空口白说的话了。

Sii跟它不一样， 一个是用一个perm,本身没有pd的改变。 另一个是新的perm， 新的
pd, 所以要140批准了才可以用旧的pd
基于这一点, sii应该pd到了就可以交485，不管140amendment批准与否，因为没有pd 的port

485啊。可是我的律师说不行。我也查不到官方的具体解释。单单从priority date的官
方解释，应该是可以的啊。

one PD which is established by the perm.
My amendment 140 was approved one year ago. I studied this issue when the
amendment 140 was pending. I could not find any regulation regarding
submitting 485 with a pending amendment 140 either. So, I think this should
be the same as the case with a pending 140.
If an attorney rejects to file the 485 in such case, I think he/she should
provide the customers solid evidence.

I have reviewed the law and some old files and although I can see that we
have had cases approved just like yours when there was no new I-140 filed by
the successor-in-interest employer, it is a much better idea to file one.
I am confident that we can file the I-140 ASAP and if your priority date is
current, we can file the I-485 while the new I-140 is pending as long as we
have a receipt. As far as premium processing goes, there are certain times
that amended I-140s may not be premium processed, but your case is not among
those and I am confident that your new I-140 may in fact be premium process
if you want to do that.
I am going to now email your employer and will copy you.

我昨天几乎找了一下午加晚上， 得出的结论时140 amendment siii pending时可以交
485, 理由是，
1 file 485 is based on pd current ( Uscis explaination)
2. For perm based 140 and 485, pd is the day u submit perm to DOL ( Uscis
definition)
3. Since sii 140 amendment is based on original perm, the pd should be the
original pd
4. Sii 140 is amendment is different from new 140 for employer/category
transfer where a new perm is filed with a new pd |

发帖数: 2622 | 84 hand and crying. Same here, 06/07 PD. Atlanta center. PERM got messed up by
multi people, got audited, denied, appealed, and finally approved end of
2008. And we just filed my H-1b extension with the original I-140. Don't
know what's gonna happen to that one, because technicially its no longer
good based on my understanding for the SII thing.
My hubby and I are ready to file a complaint with state Bar Association and
a law suit against the attorney if the final outcome is not satisfactory.

Chapter22是关于140的，Chapter23才是485的，移民局批140和批485的是不同的人。批
485的人重点关注Chapter23，所以在实际操作中，没有140 SII，只有原始140的人485

approved just like yours when there was no new I-140 filed by the successor-

我估计直接用原始140交485，最多被RFE，不会被deny，如果在485递交时候附上公司

Thanks for sharing your thoughts. His response was to a second email i sent
regarding my concerns over my H-1b Ext. So I don't know which case (H-1b or
GC) he was referring to given my head is messed up because of the trauma/
drama.
You are probably right. Otherwise the attorney would probably have collected
a few denial cases in the past two years for this, since the memo was
issued in 2009. Still I cannot afford to lose it or delay it because of REF.
Even the company is paying for it now, I'm personally willing to pay myself
to just get it over and don't have to worry for such a memo out there which
could potentially raise issues.
So sick of this GC thing, esp. after all the dramas. Probably the same for
the others.

核心问题是能交485，其次是I140 Premium。
通过你的律师回复，和咱们一起的分析，看来485提交应该没问题。I140 Premium存在
争议，但如 MVN 所说，就按premium办，给seperate check，即使被否决也没损失，最
多就走standard process。
我的PD比你们晚，是08初的。所以关于提交485，我准备等我的PD快到的时候再与我的
律师争辩。
现在还有一些问题。
1.现在能为申请485绿卡准备什么材料？
律师告诉我什么都不用准备。我查了一下，至少我可以去准备 出生证明，婚姻证明，
无犯罪记录证明。这几样，都需要我家人在中国去办。需要提早准备。不知道还有没有
什么需要提前准备的。
2.听说现在485一批准，一个月后就能拿到绿卡，是真的吗？
3.什么时候能跳槽？原来大家都说交485后半年。又有人说拿到绿卡后。但又有人说拿
到绿卡后半年才稳妥。
咱们几个情况一样，很不容易，以后互相多通气。

年, 那么你不用等满半年就可以跳了. 但谁保证你的485一定会PENDING半年以上呢, 所
以保险其间还是等半年再跳

relink生效后才能递485。
但是我也看到有另外的case说如果递140的时候没有要求relink to earlier priority
date,你递485的同时也可以要求relink，attach PERM approval notice with earlier
priority date就可以。这样的话变成即使你有relink要求，只要你的earlier
priority date变成current,你就可以同时递140和485。当然保险的做法肯定是先140，
relink成功后再递485。。。
relink to the previous priority date. Given it is current, you can submit
485. USCIS website has an example, in that example the beneficial changed to
EB2 from previous EB3 application.

现在只有一个PERM和PD, 而且即使140 amendment批了也还是只有一个PERM和PD
所以根本不涉及到PD relink
根据移民局的解释, PD就是PERM 递到DOL的那天, 如果不要走PERM, 那就是递140的那天
LZ的情况是要走PERM, 所以就是PERM 交到DOL的那天. 原来的140 和amended 140都是
基于同一个PERM的
如果换雇主, 或换EB类别, 那就有两个PERM两个PD了, 就会产生pd relink 的问题 |
