could not close on time.
Your best alternative will be closing with cash. You may get loan from
your 401k etc. of course, you may do private loan if your friend has enough
money to lend to you.
Are you using Provident Funding? hope not. This is a good example that for
purchase, the most important thing is close on time smoothly, not just the
rate.

attorney。。。
mortgage通常是 3周+1周,但如果你加急,可能缩短。如果还有时间,可以考虑迅速换
一个lender。你手上贷款材料是通用的,多问问几家。如果他们接受你现有的
appraisal report就更好了。
BTW,这几天mortgage rate正好下来了,30 year fixed with no closing cost只有4.
25%(lender是个大家都知道的大银行),我刚lock。
我也好奇问懂行的:那个lender commitment想延期就延期的吗?那还叫什么
commitment?

The commitment letter. I assume the commitment date already passed.
And I don't think he will have enough time to
find another lender unless he is working with a correspondent lender who
can move internally to a different investor.
I have a case that we originally lock the rate with Chase then last minute
Chase said they can't accept the loan. We internally moved to Citibank 3
days before closing and closed on time.

来了,银行不能按时closing,就是银行的错,理论上应该可以要律师喊银行赔偿损失。
现在可以给屋主付延迟天数的地税保险等等,拟补屋主损失,看对方能不能给你多点时
间。
如果楼上有给你好的建议,请你把你现在的银行曝光,理由等等,让其他人学习。 |

担。
如果commitment 出来,就说明银行出信的时候已经愿意借钱,如果借钱人能证明自己
没有错,错的地方在银行的话,律师是有权可以提告的。这个原因要楼主自己才知道。
不过当然这是理论上,这个点上估计没有买主会再愿意折腾。

已经loosely used, misused and abused. 看这个zillow帖子。

很多时候commitment就是一个contional approval,比pre-approval强点,但还不是
final approval。所以我们想想的叫做CLEAN commitment,and be clear to close.
可能楼主的那个commitment不是clean的,没法hold lender responsible,否则lz也不
会着急了。
BTW, per the 2nd last post of that thread, even AFTER final approve, you
are not 100% safe. The lender might still do something that affects the
closing such as they may ask for a verification of employment and pull your
credit reports just one day before closing...
