们早一个多车位的位置是一辆大的SUV。它转到路中间时，我就看到红灯我们左边那个
方向来了辆pickup，怎么没有明显减速，果然眼见着就撞上SUV的左边。我们赶紧停车
，这时左转灯马上转红了。幸好两个都是大车，看着都有人下来，人应该都没事。不过
要是我们的小车，就要惨了。
再变绿灯后我们就走了。然后路上讨论刚才是不是应该offer做witness。要是那个
pickup司机很坏，一口咬定他自己是绿灯的话，SUV就倒霉死了。一般witness是车祸人

说我可能看的是下一个绿灯，因为两个交通灯离得特别近，这个地点曾经发生过好几起
类似的车祸。可我天天走这条路接送我女儿，我对路况很熟悉，不可能看错。再说那老
太是从住宅区的小路开出来的，限速最多25，又是cross intersection,她不应该开那
么快，她当时绝对超速了，而且根本没刹车，否则她的Lexus sedan车头不可能撞得稀
巴烂，肯定total了。我的2011年的Toyota Highlander 右侧车头和车尾都被撞坏，轮
胎也被刮爆，维修要$16K（车价的一半）。幸好我的车大, 我和孩子（car seat在右侧

灯，老太那边是绿灯，我ran through red light。一个人有可能同时看清互相垂直的
两个方向的信号灯吗？我记得当时还有两个人和witness在一起，但他们说没看清什么
，就先走了。我可以把这个情况告诉claim adjustor吗？还有claim adjustor说她在等
警察的报告，警察当时给我的traffic collision info exchange的copy上没有任何结
论，他们事后会单凭一个witness的证词来判定是我的错吗？ |

lane, 拐的过程中车头与右边lane的车发成了擦挂，他的车左边有明显擦痕，我的车右
前变形。
无法回忆起来为什么会擦到他，感觉就是突然出现在了我的右边，当然我觉得很可能是
我的责任，因为有witness说我可能越过lane的线上了。
警察过来听了witness的描述，给了个incident no.就走了。
现在的问题是我的保险没有collision, 如果警察听witness的判定是我的责任那是不是
意味着我要自己掏腰包来修了？

我们的车被撞了，叫了警察，当场警察给对方ticket，我们没ticket，对方保险公司也
同意赔偿所有损失。可是今天突然收到court的一张单子，写着“change in court
date. You are hereby notified that the court matter(s),listed below, has
been rescheduled for 01/28/2013 above", 然后底下列着violation的时间和条款 （
我查了，是careless driving），violation name是对方的名字。
传单上还写着，witness for state copy. 难度我们是去当witness? 我们的车被撞的
时候，我们的确在车上。可是我们不是受害者么？难道是对方不服警察判决，然后上诉
，法庭要我们去当witness?
这是啥情况阿？怎么处理呢？我们在New Jersey. |

第二现场。 从你的照片来看， 应该是后面车CUT IN来不及煞车。如果你所说属实的话
，对方明显烂人， 保险都不对, 不排除作伪证的可能。 找律师。抓住一下两点：
1。 提供照片碰撞部位。如果是你CUT-IN的话绝不可能撞右角。
2。 弄清WITNESS打警察电话有没有先提CASE NUMBER. 没听说过WITNESS主动联系警察
的。 如果可能要录音。要跟WITNESS对峙。

走了。刚走没2步，想起来至少要报告警察，so i called 911. 后来还是不放心，又
专门回去看一趟。
我回去看他们的时候，那个suv driver也认识我这辆车，我问他和那个撞他的driver,
are your guys okay, i already called the cop, 人家也没跟我提出做什么witness.
. 当然因为我当时确实和别人约好了时间，所以也没有主动提出做witness.

这是一个非常典型的left turn accident，车祸是这样发生的：2013年7月9日，大概晚
上10：30，我从东向西行驶经过一个有红绿灯的路口，当时我是绿灯，所以我也没有多

，经过一番问话，我没有去急诊室，我离开救护车，发现对方的车已经被拖走，拖车正
在拖我的车，对方应该这个时候已经被送往急救室

位于somerville-revere-medford, MA三地交界处，从revere beach pkwy到Fellsway的
红绿灯下。
经过：
三条lane的路口，有一点拐弯，我在最左侧，truck在中间冲上来，witness lady在最
右侧。
truck可能是要闯黄灯，然后车身向我左边车道逼近，大尾巴占了我差不多1/3的lane，
然后我已经靠近路肩了，躲不了就听见了车体滋滋摩擦声… 我和右边的lady被红灯
block下来，然后她说：I saw that and he will probably pull over in the front
… 绿灯后我俩都冲了出去，过了两个traffic light在最后快上I93高速的那个traffic
light处追上了。lady很彪悍stop在truck前面说后面车被你碰了，我趁机赶紧拍下了
truck的plate number。可那个truck driver根本不理，方向盘打左，绕开lady直接上
了highway… lady下车给我她电话和名字说可以做witness。

右转的车直接快速的从我身边开过，完全没有减速的意思，反光镜撞在了我的肩膀上，
镜子都被撞得折了进去。
黑人司机，开那种很旧的凯迪拉克，有保险。后来警察来，已 file police report.有
第三者witness愿意作证
可能身体没有大碍（还需要检查），但是这个experience实在太fritening了，差一点
可能就撞到我的腰。也不能让黑人觉得我们中国人好欺负，所以决定file police
report,
黑人警察说可能我当时处在他车右前方的Blind spot所以他没有看到,我觉得不可能；
即便是，右转的时候也应该先观察
行人，而不是加速。
我想请问大家有没有什么好的建议？
1. 应该如何处理insurance? 有没有可能我去检查了，没有问题，insurance拒绝
reimburse? 我需不需要out-of-pocket medical expense, 还是凭police report和对
方insurance 免费检查？

不留神就开到了DC东南。在过一个十字路口的时候被一辆Lexus SUV撞到侧面。我当时
就蒙了，当时我叫我朋友打电话叫警察，等警察来了之后才下车。警察问我的驾照和保
险信息，问道对方的时候，发现对方没有驾照，是一个老墨teenage，开的他父亲的车
出来。警察问我当时的情况，我说当时我看见是绿灯的时候走过去，我和我朋友一口咬
定当时是绿灯，是对方责任。我们又告诉警察能不能调用路灯上的摄像头看看，警察说
摄像头不是他们的没法看。然后突然出来一老黑说是我的fault，愿意给对方做witness
。警察给我了个Case number，让我十天之后去领事故报告。警察当时告诉我：you’ll
be fine, don’t worry and go ahead. 旁边另一个警察把老墨给拷走了，警察告诉
我他至少要被关两个月。
车的状况大概是，fender和车灯完全撞坏，车轮和suspension也有损伤。现在修理厂和
保险公司的修理估价大约要一万美元，剩下还有大约一半没估计完。我现在比较担心我

今天老婆又去了急诊。全身照了x光。确认骨头没问题。但是很多地方拉伤跟淤青。小
孩目前正常。明天预约了家庭医生，我会询问可能出现的情况，给小孩做个没用辐射的
全面检查。（小孩不适合照X光）。
我今天也去警察局要了报告。报告上写着，对方司机说她是绿灯，然后警察找到
witness，说对方司机是红灯，但是闯过去了，然后撞上了我的车。
这事本来不想闹大，但是看到这么不要脸的人，还撒谎！（相当初我第一次出了小事故
，第一时间向警察承认了自己的过失，真是太天真了）我一家老小差点都被她弄死了，
这次我决定下血本，找最好的律师，搞到保险的上限再说。
对方保险公司是state farm，目前看，也不是特别负责。出了这么大的case，居然不第
一时间联系我，我的车还在拖车公司那，今天还是麻烦同学带我去租车的。老婆腰疼，
一个在家带娃，十分不便。我去租车后，带她俩去医院，然后我自己带小孩回来睡觉。
晚上还是请同学借我老婆回来的。折腾了一圈人。
我给对方保险公司打过电话，他们在记录我case的时候，发现对方司机已经claim了，

发帖数: 9308 | 33 几个月前，参加过一个律师举办的遗嘱知识普及会，有些记不清，也有些可能不准确：
1、跟lz所说的一样，这个监护人，一定要找US residents。而且，一定要自己指定，
政府指定的可能根本不是你希望的。从另外一个角度讲，政府指定的监护人，一般收取
的费用比较高，好像是遗产总额的5%左右（如果不对，请指出），如果是自己选定的朋
友或亲戚，应该不会这么高。
2、几个Witness?有的州2个，有的州3个，有些州的遗嘱基本上一样，就是这个witness
数目的差别，因此，最好一律找3个人。
3、公证(Affidavit)，虽然不是必须的，但建议做。在遗嘱被争执或法院调查真实性的
时候，如果没有做Affidavit，3个Witnees必须同时在场才能判断，试想万一其中1人因
故不能出席，遗嘱就不能生效。做过Affidavit后，遗嘱就跟这3个witness没有关系了。
4、是否找律师，争议比较大。简单的原则是，如果case比较单纯，比如：财产不是太
多，没有财产要按某种比例分配给多人，房产少或没有，等等，自己网上donw一个kit
就行了。因为，只要能通过政府的probate就达到了这种“简单 |

Tempe警方说，亚利桑那州立大学的一位优秀学生星期天晚上在ASU校园附近被枪击，周一早上去世。
调查人员说，21岁的Zachary Marco从图书馆走回家的路上，两名男子抢劫并枪杀了他。

在网上看我的位置什么的都正常。
但是到了机场，航空公司说我只有预订没有出票。

位于somerville-revere-medford, MA三地交界处，从revere beach pkwy到Fellsway的
红绿灯下。
经过：
三条lane的路口，有一点拐弯，我在最左侧，truck在中间冲上来，witness lady在最
右侧。
truck可能是要闯黄灯，然后车身向我左边车道逼近，大尾巴占了我差不多1/3的lane，
然后我已经靠近路肩了，躲不了就听见了车体滋滋摩擦声… 我和右边的lady被红灯
block下来，然后她说：I saw that and he will probably pull over in the front
… 绿灯后我俩都冲了出去，过了两个traffic light在最后快上I93高速的那个traffic
light处追上了。lady很彪悍stop在truck前面说后面车被你碰了，我趁机赶紧拍下了
truck的plate number。可那个truck driver根本不理，方向盘打左，绕开lady直接上
了highway… lady下车给我她电话和名字说可以做witness。
