从NJ turnpike开始跟着两辆白色audi一路开，
我的速度一直没超过他们。
竟然在过了trenton的一个地方被警察拦住，
说我当时速度是86，我自己觉得是82左右，车上显示的。
限速可能是55，GPS说是65，
但是几个miles之前的路标有那种临时的小标志写的55，
之后没注意换没换限速。
我对警察说附近车都超速，我一路跟着别人开的，没注意速度。
当时附近车速都在70以上，连这个警察自己都是。
他说 i am not going to argue with you.
还问我是不是赶着去philly，我说是。
过一会拿ticket过来，说speeding跟我一个warning，
我当时一喜，
可接着说给我一个ticket因为我没系安全带。。。
我说我系了，你把我拦下之后我解开了，
（我以前从没被警察拦过，真不知道不能解安全带。。。）
他说我没看见不算数，
还说这是对我有利，因为要是speeding，更严重，
安全带是minor violation。
我没多说，拿了ticket和warning走了。
请问这种情况要去appeal么？胜算多大？

我在一丁字路口右转, 有stop sign, 我 full stop, 等一直行的车过， 我看左边直行
的车较远， 才右转的. 这时候一辆警车（与我反方向）看见了我, pull me over. 他
说我 stop sing 没停, 我解释说我的确停了， 只是有在里面一点. 然后他又说，
即便如此， 你没有让左边直行道上开来的车.
he give me a ticket, saying he gave me less harsh ticket for " careless
driving " instead of " fail to stop". when I go home and read the ticket,
the police choose 4-81 (Failure to observe signal), not what he claimed 4-97
( careless driving).

可是塞在车窗上的电子打印的ticket把我的车的state都打错了，，其他都是对的，，
我是外地车(IN),结
果ticket上state打成了ID，，，
那我需要交钱吗？还是错误的ticket只要邮寄回去写明ticket is defective的原因就
能waive掉？还是干脆就不用理他？
我应该不会再开回NYC去in person argue了。。。最多是写信把ticket寄回去。。。

多时候寄给你的是叫courtesy notice，就是说是一个courtesy（出于礼貌）。court寄
不寄东西给你，你都一样对ticket要负责。
警察很有可能过了ticket上的日期还没有把ticket 输入。当然也有可能永远都不输入
。警察把日期改了也应该再寄一分东西给你，但是这种东西有可能寄失。你最好时不时
联系法庭去查。
ticket这种东西在加州的statute of limitations是一年。就是说如果一年后才把案件
弄到法庭，那你就可以完全把它dismiss掉。 |

1，选3，然后官司打赢，ticket自然免了。
2，选2或者3（但官司打输了），然后当庭申请defer，
未来的12个月内如果没再吃ticket，这张ticket就免了。
defer费用$150 non refundable，另外每7年才能用一次defer。
如果12个月内再吃ticket，这张ticket还会生效，进record并且交全额罚款。
另外defer有一些限制，比如school zone吃的ticket不能用defer等等。
3，如果选2，但不想出庭，可以选择“written response”，
把你的defer request附在信中即可。选3其实也可以不出庭，
但是那样官司赢面很小，不值得。 |

fight的经验
第一张是在A城，那天是我考过驾照的一星期内的某一天，路考已经过了，但是正式驾
照还没给我，拿到的是个document，当做临时驾照，在local一个很开阔的地方，好像
限速40，我开到51，被一个警察蹲点逮到。我一直觉得这是一个好事，因为那时候对速
度确实没啥感觉（新手应该都明白），有时候一到了开阔地带，视野广了，速度开的快
而自己错觉开得慢。。。当时很紧张，又不太懂，以为是大事，到处问同学朋友。后来
按照ticket的时间去了court，先被带到一个小房间，给了两option，当时就选了一个
，多交差不多50%的fine，换得记录在local保存一年暂时不上报DOL.
PS：记得当时拿驾照前曾有学长说过警察只会在高速上抓。。。我还居然信了。。。虽
然我也没想过在local故意超速，但是可能主观上的松懈还是有的。
第二张是在B城，路上两条道，来回各一条，单黄线，其实是不可以超车的，但是因为
那是我家附近，车少，那天正好碰上一慢车，我又有急事，就越到对过的lane超掉我前

如果你遇到判罚不公的ticket，请联系和当地police department通常在一起的另一个
机构叫internal affair.我的一个警察朋友告诉我的。
这个机构是监督执法者的abuse权利的一个机构。比方说你吃了ticket，上庭也输了，
你可以到这个机构投诉给你开ticket的警察，会做书面记录之类的，然后这个警察就会
被监督起来，职业生涯上就会被记上这么一笔。如果反复遭到投诉，就会被fire掉。警
察们非常惧怕这个。
我刚吃过一张超速的ticket，绝对是警察的错误，明明是55的zone，他非要说是45。我
上庭后才发现，一个庭上至少有不少于3个人和我的ticket内容一模一样，来自同一个
警察，连超速的速度都一模一样。

标 题: 今天拿了一张ticket，结果老婆说

下班时回家心切，转另一条高速时在路肩想插个队，结果给埋伏的条子抓住了。还好，
60刀的ticket，没点。两年没拿ticket了。
回家跟老婆说了，一半当笑话，一半指望老婆安慰一句。结果这女人脸一沉，甩了一句
，“我辛辛苦苦省多少次才省那么几十块，给你一张ticket就全泡汤了”。她是认真的。
这个蠢女人，以后不跟你说事你就高兴了。你不小心摔了上百的东西，拿了几百的
ticket，哥第一时间赶紧说没事没事，怕她难受。
说话做事老是这德性，能指望一起过到老？ |

2张ticket at one time(toll)
In sum, 6 tickets and 2 towing。waive了一个toll ticket,但charge了
administration and transaction fee。
车停着没动被人撞了，就镜子和车尾灯撞了，那人开始说赔后来耍赖了。我嫌麻烦没

比如ticket背面要求出庭前5天要把一封信寄给法庭，是否在信里要先把ticket的罚款
用check附上？
我有些照片能证明我当时的ticket罚的有些冤，是否应在这封信里一并附上，并写封信
给法官？
这是我第一次想contest tickets，不知道这里的流程和需要如何做？

我的时速是31mph，限速是15mph。主要是当时真的没看到牌子。
后来我回去看，有三个小牌子，第一个写的是school zone, 第二个写的是school zone
的时间，第三个写的是speed，是那种可以闪的牌子。但是我当时真的没看见。
问问看版上有人收到类似的ticket，然后上庭的成功经验？
个人感觉如果是不是school ticket比较麻烦？法官是不是比较严厉？
个人开车两年，第一次拿ticket.这样求情是否有效？或者说因为有三个牌子没看清？
雷达的缺陷就算了，上网查了，据说是很准确的雷达，一般贵，都不用。。。 |

发帖数: 30 | 48 高速超速ticket,警察口头说不给ticket,但是给了我ticket，天黑没注意看，以为是
warning,心里很不平衡，警察竟然撒谎，决定斗争到底。
第一次去法院，安排出庭时间。
今天正式出庭，准时到达，法院开张，人太多，法官说要挺长时间。本来想找那个不厚
道的警察理论理论，但是看来看去，没见着，就问来的一帮警察，他们也很不齿这个警
察的不厚道做法，一个警察开玩笑说，估计没脸来吧。一个警察问我，是不是申请了
continuance，就是延期审判，因为一般这样，警察就不会为一个人单独出庭，他们手
里都是3+的案子，一天来划算。我心里想，这个法子挺好，我怎么没想到，而且还是警
察自己泄露给我，今后可以用用。
这帮警察估计也是平时很无聊，来法院就像聚会一样，大家都很high,我就他们开了一
会玩笑。
寒暄过后，女法官出场，一个一个，成功率在50%。到我了，检察官看啦看，叫我到一
边说，你可以走了，我说，我要challenge the ticket， 他说，we dismissed the
ticket, and you are free to go. 那几个警察向我挤眉弄眼，估计是说， |

LD从Atlanta回来的路上不幸得到的。当时他一个人驾车。刚从国内飞回来（刚下飞机
），还没完全适应美国的限速。据他回忆，当时只是随着前面的车一直开，并没有注意
时速是多少 （TICKET上后来写的是89 M在一个70 M的area）.
拦住他的警察很mean, 不容分说开了一个这么大的ticket。LD英文又不行，也没法当面
争取一下。后来我打过去电话问Court,说是不用出庭，我又问为什么400多罚款，对方
说是因为不在一个Courty (这个那位大侠有经验，有这样的说法“不同区，ticket就贵
出几倍么？）。
现在想写written request 申请court减少fine或者appeal not guilty, 大家给出出主
意怎么写呀？实在没经验，这是我们第一个ticket。

写金额？

==》400的确发的比较多。写信基本无用，建议找时间上庭。主要理由：1.第一张
ticket，历史清白，2.申请上课减免罚单。
要是警察不去你就赚到了，下回千万不要超速那么多。 |
