在房产交易进入中后期,如果你是买方,在escrow company给你寄的escrow
documents中有一份是叫你specify怎样vest房产权。关于房产权的几种vesting

两人房产权的vesting, 凭着Community Property with Right of Survivorship 更加

real property ownership形式有两种:
1. tenancy in common:每个owner具有相同的使用权,但所有权可以不同,适合未婚
者(或者独立投资人)一起买房的情况,比如A可以有80%interest,B则20%,但A不能
赶B出去,B可以使用property所有的权益。以后卖的时候两人的interest不一样而已。
B去世的话,B的产权可以单独转移给C,A不能自动获得B的产权。
2. joint tenancy:每个owner具有相同使用权和interest。而且具有right of
survivorship。如果B去世,A自动获得B的产权。首先你们已经是夫妻,那么有一种特
殊的joint tenancy,叫做tenancies by the entirety。这种ownership只能created

husband and wife的那种是Tenancy in Entirety, 另外一种Joint Tenancy。其实现
在Tenancy in Entirety并不常见。区别是Tenancy in Entirety把夫妻看成一个人。

自己看吧,制定“押金”法律的目的基本就是为了防止押金交了拿不回来的,而不是逼
迫人交押金
如果房东不能出示证据自己的损失是多少,可以从押金里扣掉,就要在30天内退钱,否
则房客就可以要求三倍的赔偿,做房东真是被法律歧视啊
而且法院的判决永远都是先退押金,房东再另开一案要求补偿自己的损失

房东是一 Car Dealer, 而且多次违背诺言。去年底和他签了一个两年的租约,明年年
底到期。但现在他又要买房子(两年前没卖出,一大堆人来看房子,让我不胜其扰),

facts:根据你说的,这是一个tenancy for years,ie.有租住期限的,而不是tenancy
at will, ie.双方可以任意时间,随意解除landlord tenancy关系。
如果你要解决的是“气不过”:找个collection agency,哪怕out of pocket自己花点
钱雇他们都可以,弄个讨债,把对方SSN报上去,然后对方信用记录上加一笔,这样的
影响深远。如果对方海外学成归国,那你这样做效果有限。
如果你要解决的是“损失弥补”:只能告他们。理由是:也许,是说也许,你的租约是
违反规定的,也就是说不合法出租,但是除非那个规定“出租许可”的法律明确说:如
果你没许可就出租,那么你在法律上就没有任何recourse,除非那个法律specifically
这么说。你至少可以:
1) 承认合同无效,但可以claim unjustified enrichment.就是说对方由于在你这里住
,得到了好处,那么这个好处要吐出来,注意:这个只是对方得到的好处,而不是你损
失的。在你这个案子里,恐怕很少,基本上是打扫房间的费用,因为对方以前的租金都

multi-tenancy是个伪命题,
本来是为了通过省Resource省钱,
结果开发上维护上安全上要多花很多。
除非你的tenancy is as small as individuals,
某种意义上只要支持personalization
就是multi-tenancy了。

本人和房东有个半年的lease,该lease 应该在Jan. 31, 2013到期。我24号联系房东,
结果被告知我没有提前30天给他们notice,现在我的lease要自动转成month to month,
我要多交一个月的房租。

房东说30天notice是州法律规定的。好吧,麻烦诸位看看是我的错还是她的错:

小弟来加州才不久,在cupertino一家租房公司租了短期的几个月的房子。现在租房还
有5天要到期,于是向房屋管理人员提出到期以后准备搬走。结果租房公司人员以我没
有提前30天告知他们我要搬走为理由,要给我处30天的房租(month by month)的罚款
。 因为租房之前交过3000的押金,所以这次要全部没收并且还要补交1000。 本人在其
他州租房很多次,第一次了解到还有这种规定。
小弟以为lease上签订了日期,就是默认到期那天就要走,没有必要额外再给租房公司
提前30天的notice。
不过回家后仔细看lease,发现上面确实有这么一条:

1. Management Fees – 10% of the gross monthly rents collected that month.
2. Leasing fees for New Tenancies – 50% of one full month’s rent
3. Fees Related to Insurance and Legal Matters - $30 per hour
4. Reserves hold in a trust account as a reserve for owner: $250.00
5. Fee if a tenant purchases Property: 2% of the sales price
6. A public Policy for that names Broker as a co-insured

举例好了,你和你的生意伙伴拥有房产,你20%他80%,tenancy in common.
你和你兄弟拥有房产,你们一人一半,joint tenancy
你和你配偶夫妻共同财产,一人一半,community property
你和你配偶夫妻共同财产,且一方死后不用立刻分割财产,community property with

CHECK LIST上应该有以下内容需要问清楚房东的。这些都是比讲价更重要的!
在一定价钱下:
1。是否包水电,电话线,或宽带
宽带的设备比如线是否要自己出?按理说应该是房东负责,否则就不是BOARD了。
2。是否需要轮值打扫公共地区比如走廊厕所厨房

请教大家,我知道的购房title有以下4种
how to hold title:(决定)产权的持有方式(有以下四种:)
1)joint tenancy:联合持有财产权(可为任何人数,也是美国夫妻之间最常用的一种
持有方式)
2)tenancy in common:共同持有财产权(可为任何人数)
3)community property:夫妻共有财产权(仅限于夫妻)
4)community property with right of survivorship:可由配偶继承的夫妻共有财产
权(仅限于夫妻)
但是今天看到购房合同里没有涉及title,有写购房者的关系,比如夫妻。
问了西雅图另外一个已买到房子的朋友,他们拿到的产权证上也就是写夫妻。
那么说产权的持有方式会在哪里显示呢?还是说夫妻也是一种产权的持有方式?

month-to-month tenancy. It specifies the only reasons for which a tenant in
Seattle may be required to move, and requires owners to state the reason,
in writing, for ending a tenancy when giving a termination notice.
所以你不是很容易随时让month to month的租客走人。你可以编造一个“good cause”
,但是你也得承担编造这个理由的风险。有这种真实理由的时候不多。

Only want to comment on the first one based on property law.
The lease you had was "tenancy at will", both you and the landlord can
terminate the lease any time you want;
if you pay rent once a month, then this lease become "periodic tenancy",
both you and the landlord could terminate the lease as long as you inform
the other party 1 period ahead. In your case, that was 1 month.
So don't indulge in "法律保护房客". It really depends on what kind of lease
