。申了几个月一点消息都没有，觉得自己就一直在做无用功，就快要放弃工业界回去找
博后了。
公司是Pfizer，是Group Head/Director直接email联系的。当时收到信的时候是狂喜啊
，抱着老公尖叫有没有……
我申了该部门的两个不同方向的position，偏偏email里又没明说是哪个position。于
是把linkedin, PubMed都用上，终于找出她面试我的是哪个职位了。精华区里的电话面
试经验好像都太泛泛，这个情况下必须集中准备专业知识。
然后刚刚电话来了。第一个问题是：“你需要sponsorship吗？这个职位比较特殊，只
招citizen或者有绿卡的。”真是坑老娘啊，幸亏没有准备得太刻苦，周六差点为了这
个面试把娱乐活动给推了。
很老实地回答说没有，接着说但是我有至少一年的时间是不需要sponsorship的。对方
说就是不行，没办法。
不过我赶紧把她抓住问了一堆问题（哈哈，换成我面试她了）。对方很nice，耐心地回

除非，和IT CS相关，或是senior manager以上或是director以上级别
还是得投相应的工作，才会有recruiter来联系
另外可以用h1bwage来查该公司是不是以前有过h1b记录，不仅要看公司还要看相关职位
是不是有记录
不过还是有不少公司是support的，一般recruiter第一个问题会问你的身份问题，我遇
到过有意向，但是知道需要h1b后就告诉你等绿卡之后再联系他们的，也遇到过h1bwage
没记录，但是听到有整一年opt就觉得没有问题，会sponsorship的，你没有opt就挺难
，公司也要试用试用你，感觉不好，就不给你sponsorship了，你要求直接h1b的，估计
对方公司会想一想，值不值得冒这个险，有同等的其他candidate肯定优先考虑别人 |

我前阵子看到了一个intern的职位就申请了。hr发了一些preliminary questions让我
回答，里面有一个问题，will you now or in the future need sponsorship? 我回答
了no。当时没想那么说，想着intern一般都几个月，我的stem opt够cover这段时间了
，我专业虽然是stem，但是工作很不好找，心想有个intern也是好的，再找工作也简单
些了，打算边实习边找其他的full time position，也没想着intern的时候和公司要
sponsor，因为本来我这专业entry level都是不给sponsor的。而且，我看版里有前辈
说，opt做intern是没问题的，就坦荡荡的回答了no。（还挺自信的。。。）后来hr电
面，过了。
第二次hr打电话过来和我约与hiring manager的电面时间，又问了一遍will you now

在美国工作都要working permit, 绿卡/公民是永久permit.H1等(如J类）是临时permit
, 且一个雇主一个H1。你要有>=2份工作也行，每份工都要有permit.
LZ是H1，是其现雇主sponsor的。如果LZ“开一个公司，所有事都是一个人做”，这就
是一份工作，就要permit。理论上LZ的公司可以给LZ办H1，但做起来就不容易了，至少
有这样的问题：谁来签这个H1 sponsorship的application form? 自己是不能为自己签
申请的。比较复杂，要找熟悉这方面的律师。
所以说，LZ假设的自己开公司自己干不合法。公司必须雇佣至少一个有合法工作许可的
运营者，比如绿卡/公民。485 EAD可以说是准绿卡。用了EAD就失去H1身分，也就不受
H1限制，可以有多分工作而不需employer sponsorship。 但是如果是employment
based 485，主要工作必须与以前申请劳工证类似，因为现在的485/EAD都是基于那个劳
工证了。 |

拿到SPONSORSHIP NUMBER然后去申请签证大概2个星期左右就可以拿到。签证到手之日

拿3个月工资立刻终止H1B sponsorship（某人要自己转换去H4). 一个是继续呆在
payroll上3个月，每两星期发一次工资，三个月之后自动合同和sponsorship结束，期
间要是找到其他工作，那么工资就不再发了。
我的疑问是这第二个选项确实可行么？H1B应该是建立在work full time的基础上的吧
。只是有payroll这按理也不满足劳动部LCA要求吧。 |

NIW 是 National Interest Waiver的缩写，是无需雇主sponsorship的一种绿卡申请类
别，隶属EB-2. 申请者需要出示证据证明其工作或者技能符合美国的国家利益，并且申
请者已经或者能够在他的领域内作出突出的贡献。NIW的申请也分140和485两步，由于
隶属EB-2,在中国大陆和印度出生的申请者在140批准后需要排期才能提交485.
2. Qualification
NIW虽然不需要雇主的sponsorship, 但既然属于EB系列，那么申请者必须有工作。以前
也有很多F-1学生申请成功，但学生申请会有一些风险，比如回国返签，OPT申请等问题
。尤其现阶段NIWer需要排期，即使140批准也需要等待几年（“几”现阶段>=5年）时
间才能递交485，再加上提交NIW之后理论上不能转回学生身份，所以大陆出生的学生或
者postdoc申请NIW应该十分谨慎。一旦申请递出，保住工作或者在美国的合法身份是王
道之举。对于中国大陆出生的移民者来说，就目前形势而言，NIW比较适用于工作稳定

sponsorship 的questionaire，应该怎么办，是就干等着DOL的人打电话来验证
sponsorship，还是应该叫attorney withdrawal and refile？我现在已经是最后一年
了，perm递交日和h1b到期日差10天不满365天，而且如果refile perm可能还要重新打
广告，因为已经超过180天了。真是被公司找的移民律师气死了。大家给出个主意吧。 |

虽然case比较弱，还是想试一下。没想工作才2个月，就被学校搞，逼我辞职，一点余
地也不留，无奈之下偶找了employment lawyer，律师给学校发信后，现在学校示弱了
（估计知道自己不占理），说可以让我回去继续工作。下月初，我和律师会同学校相关
人员meeting，到时会和学校谈条件。其中包括eb1b的sponsorship问题。
虽然3个月前就打算申请eb1b，但中间发生了这事后，别说eb1b，其实早就做好了回国
的准备了，所以到现在对eb1b申请的操作也不是很熟练。现在事情有所转机，就想把这
个事情重新拾起来。到时和学校谈判，我会逼迫其就我申请eb1b提供相关支持（比如相
关文件的签字等等）。但为了避免对方出尔反尔，我想在最快的时间内拿到相关的支持
性文件。相关方面的问题，我想请版上的xdjm给把下关。据我所知，雇主方面提供的资
料主要有：
offer letter （之前在版上问过，我的不是很符合要求，到时会要求学校做点改动）
