这是有这221个人参与了这起class action的诉讼，诉讼是关于"Unintended
Acceleration Marketing, Sales Practices, and Products Liability Litigation"
。221个人认定丰田违反担保、不当获利和违反各州的消费者保护法等为由提出索赔主

闯的红灯。 所以没把这事怎么放在心上。 过了半年多以后， 收到了对方律师的传票
。过不多久， 我的律师来信告诉我退出我的案子。 因为他说对方的保险公司和律师已
经有证人的口供， 证人说是我闯的红灯。我的保险公司为我指派了一个辩护律师（太
差劲的保险公司， 没在第一时间录口供）。联系我保险公司的律师， 好像她看到我的
律师都已经退出， 觉得赢的希望不大，想和对方settle。打电话联系了差不多10个law
office， 没有一个愿意接我的案子。 我感觉一个原因是我的案子太小（treatment

有一回先跟对方发信确认，再fedex overnight，签收了，结果是盗用，信用卡公司
charge back，paypal赔了。
另一回USPS priority寄了，无法投递，邮回来给我了。结果又是骗子，信用卡公司
charge back以后磨蹭了很久，paypal从我的帐户扣钱全赔给对方，另外paypal fee不
退，还要charge 20刀的settlement fee。
还有一回，没有寄，结果还是骗子，信用卡公司charge back，又磨蹭了很久，paypal
也是从我帐户扣钱全退给对方，paypal fee不退给我，又charge 了20刀settlement
fee。
你说我们这些游医小打小闹的，厚道一点吧，做多少才够赔这些paypal fee和

我雇佣了一只来自North Carolina的builder的施工队，房子盖完后到处漏水，我扣住
最后大约7%的施工费未付。他们修复了几次未修好，然后老板就把施工队fire掉，自己
带了3个人来修。老板目的是要尽快拿到最后一笔钱，带来的人简单地Caulking一下，
老板就指天发誓绝对不会漏了，催着要钱，我坚持需要等下雨核实一下。正好那个星期
几乎每天晚上下雨，每天早上漏雨的地方都没有任何改进，Caulking这种方式就算work
，也只能是暂时的，几个月后还会漏。三次以后。老板突然变脸，先是声称有邻居半夜

出了二十五万。因为当时忙着出差，中介的信誉也很好，就全权交给了她（从签合同到
申请贷款）。当时她说如果用她的贷款的话，不会超过五千，但现在最终结果却是六千
五百多点。所以约她来看看到底什么地方被多收了，或者可以避免。

our inspectors recommendation is, settlement is common, it's fine as long as
it's not getting worse. also, by analyzing the building structure,
sometimes you can figure out why it has the settlement, for example, there
is no foundation underneath, there are structral damage, etc...
why not ask your inspector? |

房子listing price $495,000, 我们出价$490,000, 要$5000 closing cost.
银行的approve letter上面是这么写的
The required payoff to xxxxxx Credit Union is $436,676.98, scheduled for
settlement on or before 5/31/12. Settlement costs to the seller may not
exceed $46,363.98. 这$$46,363.98里面包括了real estate commission, attorney
fee还是乱七八糟的费用，其中一个是2011 delinquent property tax.
我们问agent是不是屋主就只欠银行436,676, 他解释说这个payoff和settlement fee是
银行按照我们给的价格quote出来的，并不是屋主实际欠银行的。是这样的吗？

他不能肯定的是这个是否是个大问题。这个从表面上看不出来。
大部分房子建成后都会有Settlement，只是程度和时间的问题，有的几年，有的十几年
，还有的更长。
如果你这个房子的settlement已经停了，这就没问题了。
我理解你的inspector的意思就是他没办法判断这个过程是否已经结束。这个是实话。 |

关于2，是这样的。先付一点，然后逐渐在closing前付清。如果自己找贷款公司，最大
的问题是我得到的答复最长能锁定3个月，而房子的建筑周期最快是3个月。另外，不知
道自己找的贷款公司是否能把整个settlement fee做得显著低于建筑商指定的公司。比
方说，建筑商送5000 closing fee，但是整个settlement 要9000刀，加4%利率。如果
自己找的公司给地利率，并且整个settlement fee能做得显著低于9000，理论上是合算
的。问题就在于利率的锁定不能等到房子建完，不知道利率的未来半年内的走势。
签的合同就是卖房合同。不是贷款合同。 |

我看上一个房子，看到seller的disclosure上关于房子结构部分，seller提到有问题，
并且修过。下面是他们对这个问题的解释：
The brick veneer crack just above the garage door was repaired and also the
reason 'unreasonable settlement' settlement was checked. The work was undert
aken by JSA Specialists. The pier(s) were installed underneath the center c
olumn of the garage, while previously it was sitting on driveway which cause
d the settlement(crack).
车库上面还有一个卧室，如果没有卧室的话，我们不是特别在意，但是有卧室的话，这
样的问题是否严重？

的过户日期是12/20，那么在settlement statement 上 title company 会让seller把
10/1-12/20的水费付给你 （title company 会让seller或者供水公司提供证明这段
时间的用量是多少，然后根据单价算出来总额）。当due date 到来的时候，你一并支
付给供水公司。
HOA 的费用一般都是先付的，seller 可能在12/1就把12月一整月的HOA FEE 付了，那
么在settlement statement 上 title company 会让你把12/21-12/31的HOA fee付给
seller.
Insurance应该不存在和seller分摊的问题。
签字过户的时候，title company 会把相关费用反应在settlement statement上按天分
摊给买卖双方，过户之后，买卖双方互不相欠。 |

1)澳大利亚的surcharge逐步推广是从noncompetitive sectors(比如航空,旅馆,出租)
开始的. 等大家逐渐习惯surcharge, 其他行业才开始跟进. 目前大概有40%的主流零售
商收取2%左右的surcharge.
美国的商家要真的推广surcharge, 恐怕也要从会是这样一个"温水煮青蛙"过程. 比如
旅店的resort fee, 客户也无可奈何.
2) AMEX并没有加入这个settlement, 支持AMEX的商家并不能在AMEX cc消费上
surcharge.
3) 有10个州(其人口占全美40%)的法律禁止商家surcharge信用卡消费

简单的例子, MA州关于confientiality provision的说明:
"A confientiality provision is part of the settlement
document that is signed by all parties involved in the
case when a monetary settlement is reached. In the agreement,
the plaintiff and his or her attorney agree to keep the
settlement amount and the details of the case private."
随便到网上google 一下 malpractice confientiality agreement
就能得到类似的信息.
人家民事官司的法律文件, 法庭知道, 双方知道, 凭什么要给你公开?

我觉得另外就是收集证据告这家幼儿园，要求赔偿。这个是人为疏忽导致的事故，赔偿
是跑不了的。

记不清了是OEX换成SPX还是SPX换成OEX了，谢谢。
UX1-UX2这个我确实没看到，按settlement算不对，
settlement是周三，那个时候UX1已经没了，只是开盘SOQ固定了。
UX2当天可以大幅变动。
应该按周二过期日算，从没看过超过4.5的之前,除非之前UX不是每个月，
1和2之间隔了三个月那种。
