ＩＰ ＧＲＯＵＰ大，是否更好．

for patent practise, there are two types of patent related position - patent
prosecution and patent litigation.
A person with technical background will most likely become an attorney in

发帖数: 122 | 41 难道我的样本偏差这么大吗。我那个学校前后几届的中国JD，除了一个做IP litigation
的，其他不管以前是文科还是理工科背景，毕业全部进大所做corporate了。很难吗？
还有作IP的，为什么大家一说就是给人申请专利呢？Patent prosecution那是IP里面入
门要求最低，最容易被outsource，profit margin最低的一个部分。IP里面除了patent
prosecution，其他的都不需要理科背景。可能有人说理科背景还是有帮助，好吧，对
于patent litigation可能有部分帮助，但是做patent litigation仍然完全不必须理科
背景，多的是以前学历史政治的人在做。而且IP除了专利，还包括trademark, trade
secrets, copyright等等。这些更是不要求什么理科背景了。如果是日常的soft IP
portfolio management，更多的是需要跟客户搞好关系，怎么作strategic planning。

的工作，因为就是不喜欢engineering才去学的法律。
但是近来考虑还是向patent law靠一靠吧，形势所迫。请教各位大侠几个问题：
1. 我的engineering学得不太扎实，做patent prosecution可以吗？
2. 工作中是engineering的东西和法律的东西各占多少比例？仍然需要花时间分析技术
问题吗？我可不想念了law school还得去研究头疼的图纸。
3. 是否大家去做patent prosecution的多，做patent litigation的比较少？是因为比
较难以得到patent litigation的工作吗？
3. 做patent prosecution的每天到底做什么？麻烦各位详细解释一下。

但是prosecution不像litigation那么有挑战性。我可能比较局限，只做patent
prosecution和litigation。看来真的是围城啊。城外的都羡慕我们。

California legal market.
First, LZ's starting point is wrong. If you are god at law, your
bioscience background is irrelevant. If you decide to go to law
school, forget about bioscience.
Second, be warned, law is a very competitive field. There are too
many lawyers and law students. So, if you are not the best, you have
no good job.
Third, law school ranking matters. If you are in a top 14 school (I

在过去半年多的时间里，引起海内外广泛关注的中国学界最大的新闻之一，就是贵院
2002年毕业生刘菊花硕士学位论文涉嫌抄袭事件。
据不完全统计，包括中央电视台、中央人民广播电台、新华社在内的多家权威媒体报道
了该事件，网络媒体对此事件的转载和传播更是不计其数。不仅如此，《中国日报》对
该事件的英文报道还将这一丑闻传遍了全世界。因此，依法对刘菊花硕士论文涉嫌抄袭
案加以查处，不仅事关刘菊花本人，而且关系到贵院、中国研究生与学位教育质量、人
文社会科学界乃至整个中国学术界在海内外的学术信誉。然而，半年多时间过去了，刘
菊花硕士论文抄袭事件迄今仍未见到处理结论。因此，我们决定给贵院及主要负责同志
写这封公开信，以表达我们对这一事件的严重关注。
