1. 申请人目前持有H-1B身份
2. 第6年的H-1B将在60天内到期
3. I-140若是批准，可以用优先日期还没排到，因此每次可以延三年的H-1B
4. 根据AC-21申请人的LC已经超过一 年，因此可每次延长一年的H-1B(请参阅数 天前
的AC-21新Memo中的条 件) 。
申 请I-140的Premium Processing时，申请人必须附上下列文件：
1. I-94
2. H-1B或L-1的批准通知
3. I-140的收据(如果以前已经提出申请)
4. 批准的劳工卡
这 里我 们必 须说 明。如 果LC被否决，但在上诉也是在此例当 中。CIS似乎在此忘
了注明。这个I-140Premium Processing也包 括EB-1a,b及NIW，只要是你符合以 上H-

现在说下我的情况。8月23号收到的Premium Processing Receipt.
9月3号受到RFE 1.问公司是否有接受政府的TARP FUNDING。
2.就是奥巴马的新政策什么公司雇佣外籍劳工的比例不能超过50%，否
则多交2000USD。（这2向公司都解释清楚了并且律师和老板都超负责，当天就把文件
FAX给了USICS了。并且副总裁还专门把RFE的要求和他们的解释发给我。这里是公司回
复我的The new regulation if company apply H-1 employee is exceed a certain
percentage will need to summit additional $2000 processing fee for each of
applier. On your case we don’t have that issue and together with Lawyer we
had fax the additional evide |

deny etc）的。有了解的同学么？
我是postdoc工作，现在f1 grace period，opt出了问题，考虑其他方案，其中postdoc
advisor愿意push系里帮我申h1，但要我确定申请种类后再帮我push。
请教premium processing？如果是15 calendar day，对我们都是好消息，这样就能在
我grace period内出结果，我们都更多options了，advisor也高兴更早开始。
钱不是问题。

GPA,入职时间等。然后说要最后CEO REVIEW。然后就发过去简历了，我的GPA确实不高
，3.33,然后今天recruiter发信给我，说我的GPA slightly lower than their
requirement，让我写一个GPA justification, write up a story as to why it is 3
.3. 我特意去查了他们的career site的job description，minimum GPA就是3.3，我应
该符合要求。然后就有点虚，offer process会因为这个出乱子么？我这边一个offer
deadline要到期了，希望他们快点答复，结果说他们28号才能Update，最近放假。昨天
