我和老婆的485都在美国递交了。我老婆没有等打指纹就回国了，AP也没有等到，但是
她的H4还在有效期内。我是前几天到local office办了加急AP打完指纹回国的。现在我
们都在国内，我是穿越发帖。我老婆也可以用有效的H4身份会美国，只要我没有绿（按
照现在这个速度，估计到10月份都是不会绿的）。但是因为她家里面的事，她不想急着
回美国，所以才有了上面第一个问题。
昨天我美国的朋友告诉我，我和老婆的正常AP都寄到了。当然我是不需要了，不知道她
的AP还有效吗？这样是最理想的了，我几天后回回美国就把她的AP快递回来。大家讨论
看看。

续给自己原来的雇主工作,可以extend/transfer I-797回到H1B 身份.
Parole身份和H1B身份的区别是有无H4, 485被拒的情况下, H1B可以继续在境内停留,
Parole 身份理论上不可以合法停留,要转成别的身份.

去年6月起，由于工作关系，经常国内美国两个地方跑，大部分时间在国内，3-4各月回
美住15-20天。今年6月底从SEA入境的时候被海关人员警告，说我在国外呆的时间太长
，怀疑我have no intention to live in US. 他警告说，either apply for reentry
permit, or stay in US for more than 6 months a year.
因为明年1月底就变成绿卡3年了，可以申请入籍，所以今天直接去USCIS咨询下reentry
permit以及入籍的问题，USCIS当值的是一名中年阿三。
我：如果我要经常到外国出差，我怎样才能保留我的绿卡？

我：不是reentry permit吗？ DHS officer at SEA 告诉我应该申请reentry permit.

travel。 一次是去南欧的一个国家， 一次回中国， 上周刚从西欧的一个国家回来。
说说经历吧。
南欧国家： 机场check in回美国的航班的时候，柜台的staff不知道这个combo card是
什么， 在她们的电脑上面搞了半天终于明白advance parole可以登机。 前后花了5分
钟解释查询， 最后向我道歉， 很快地办好登机牌。 可气的是中间在巴黎转机， 就
在boarding gate旁边又被检查的人（现在欧洲来美国的航班在登机门附近一般都有二
次安检和护照检查）耽误了很久。 人家就是没见过这种combo card， 后来我把485的
receipt给其看了一眼才放我进去。 回到美国三番入关，明确告知其是serve as
advance parole， 做了基本的指纹和照相， 被要求自己去secondary inspection。

我是f1, 我老公的pd这个月排到了，现在正在准备file 485。我去年12月份回国签证，
现在签证还有效。想4月份再回一趟国。但是律师的说法是拿到advanced parole之前不
要离境。我想问一下
1。 我已经有有效的f1签证，是不是还是不能回？（律师说的情况是不是指没有有效签
证的状态？）
2。 如果拿到advanced parole，能不能回？（有说法是f1身份最好不要用advanced
parole）
3。 大概多长时间能拿到advanced parole（律师说是4－6个月，但是我的朋友1个半月
就拿到）

之前有讨论一个485 AOS期间转F-1的问题，我当时认为是可以，但是有人指出不可以，
我是学到了。

5. 申请人当前身份必须合法
在合法停留期间递交的 I-485，如果其待决的非移民申请后来批准了，则坐实了其递交
I-485 时的合法身份。然而，非移民申请如果被拒，其 I-485 也将面临同样的结局。
引申来说，在 AOS 状态再申请 I-485，是瞎子点灯白费蜡。
有的同学在当前身份失效，且没超出 180 天的时候，认为由于有 245(k) 的保护，所
以仍然可以提交 I-485. 这种认识是不全面的。因为 245(k) 豁免的是工作移民的少于
180 天的身份违例，但是并没有豁免当前身份失效。

老师开的 485 课，本意是省省同学们的事儿，结果闹得有的同学堵心。不但有还没填表的同学感到
无从适从，已经交完表的同学也有忧心如焚的。今天，老师先给同学们宽宽心。
关于 485 的申请类型，有同学填了 [a]，也有同学准备填 [a]，在 140 还没批准的情况下。填
了就填了吧，想填 [a] 就填 [a]。实际上，140 还没批的 485 是不会有人来看的。等你的 485
开始处理了，你填的[a] 也就对了。
那边填了 [h] 的同学也别嚷嚷，你们填得没错。
同学们心里好受一点了？老师接下来谈谈改名字的风波。填了 None 的同学不要紧，填了 N/A 的
同学也没关系。这话儿怎么讲？且听老师慢慢道来。

现在签证还有效。想4月份再回一趟国。但是律师的说法是拿到advanced parole之前不
要离境。我想问一下
1。 我已经有有效的f1签证，是不是还是不能回？（律师说的情况是不是指没有有效签
证的状态？）
2。 如果拿到advanced parole，能不能回？（有说法是f1身份最好不要用advanced
parole）
3。 大概多长时间能拿到advanced parole（律师说是4－6个月，但是我的朋友1个半月

回美国。我听说用AP和EAD不同，还是可以保持H－1B身份。而且现在EAD申请那么多，
怕明年renew EAD时间链接不上，然后不能工作。所以还是很想回来后继续H－1B。 我
想问这里的朋友，如果回来还想保持H－1B，需要自己办理什么手续吗？需要向USCIS申
请转会H－1B吗？还是默认可以自动保持H－1B？ 如果需要向USCIS申请，这个手续是什
么？是和以前办理H－1B extension 一样的手续吗？ 公司刚刚帮我renew 了H－1B 三
年，不好意思让公司再花几千给我重新转回H－1B。

个怎么保持H－1B 和要不要花钱的问题。
比如这个 "an alien who was an H-1 or L-1 nonimmigrant, but who was paroled

2，持有的H1 VISA签证过期了，但是H1 797有效期到2016年12月我准备7月20日离境去
中国，8月20日返回美国。假设Renew AP申请会在4月1号提交，然后拖拖拉拉在8月1号
批准，然后朋友把AP带回中
国给我。
3， 我离境时的身份是H1/H4身份不是AP身份 - 因为没有使用过AP - 对吗？
4， 我回美国时可以使用8月一号批准的AP吗？ 还是必须申请H1/H4签证?
不能用新批准的ap回来。
