AP在收费表上说了495 pending时候是不交钱的，但关于工卡i765貌似比较含糊：
Adjustment Applicant--(c)(9). File Form I-765 with a copy of the receipt
notice or other evidence that your Form I-485, Application for Permanent
Residence or Adjust Status, is pending. You may file Form I-765 together
with your Form I-485.
但Fees schedule提到的下边列表没有c(9)也就是485 pending的，

费。 我是属于第一次EAD，但是initial EAD减免申请费的(c)(9)不包含在内。而且说
所有人都要缴纳$85的biometric fee。 晕了。。。

问题是,lawyer建议等到oct.1st,h1b生效以后再办

问题是再等5个月,我的priority date就晚5个月了.
请问值不值得为了5个月的排期,冒险在f1的时候就file PERM LC?

今天H1B的延期申请批了.突然发现有这么一说:

nonimmigrant status, the decision granting such an extension will have the
effect of terminating the grant of parole and admitting the alien in the
relevant nonimmigrant classification.
是不是说我的H1B延期申请的批准使我手上的AP失效了啊?

自从去年大放水时 I-140 的加快服务 (Premium Processing Service) 无限期暂定之
后，一直没有复活的迹象。本周 USCIS 新发了文，说从 6/16/08 起，I-140 的 PP 服
务有条件地恢复。
这个条件，就是受益人的六年 H-1b 即将到期而不符合延期的规定。

容都是一样的,不用点是:1. 在第一页上,F2比F1在右边多了一格,填上了F2的名字和生
日及出生地.
2. 在第三页上顶置有两行字,F1写的是: IF YOU NEED MORE INFORMATION
CONCERNING YOUR F-1 NONIMMIGRANT STUDENT STATUS AND THE THE RELATING

工作(哪怕没有EAD)，也可以通过办理H1B延期或Transfer (?)转回H1B身份。相当于H1B
的名额给你留着。
对H1B自己来说，用了AP后不是H1B了，但还可以享受H1B的优惠，所以不少人笼统的说

Finger Print: 主申请人walk-in 6/20，副申请人按notice上的时间 6/26
485 card production 6/30 （主副申请人一起）
本着和140一样的原则，我的485材料非常精简，比如身份材料，只提供了最后一次入境
美国之后的。我（主申请人）去年9月回国H1转H4，所以只提供了H4的签证复印件，以
前的H1和I20之类统统没提供。出生公证只复印了两页（中文和英文翻译），后面公证
页没
复印，因为觉得不相关。但加了一份声明（没公证），说本人懂中英文，可以证明英文
翻译是准确完全的。护照只复印了信息页和最后一次入境美国的签证（H4）。AP/EAD的
材料也非常精简，两个申请人，6份申请，加起来也就薄薄一点，不知道是不是因为这
样IO一高兴先拿出来批了，嘿嘿。

unauthorized employment, 但H1B status就是没了, 是parole status. 也就是说H1B
和AOS双重身份没了.

移民局又开闸了，于是大伙儿全来趟这浑水。不管是 140 还没填的，抑或是 pending
的，更不要说批了的了，尤其是七月二号没赶上车的，大家一齐冲向 485 高地。
485 填表战，又开始了！
有的同学过于紧张，简单的问题也不敢把握，向白老师 (xiaobaitu, 呢称 XBT, 又称
小白兔 JJ 或 小白兔 MM) 求助的贴子是满天飞呀！就象北京春天的柳絮。
老师和系主任咬过好几次耳朵，建议挂个咨询公司的牌子，向白老师问一个问题的收一
毛钱，＂在线等＂的算 Premium Service 多收五分。系主任胆子太小，今天老师还说
，我们动手罢！他却总说道Ｎｏ！——这是洋话，你们不懂的。否则早已发了。
所以老师抄起剪子和浆糊，助白老师和其他大侠一鼻之力。

发帖数: 154 | 43 看了I-131的填表指南，最新版的，看上去485 pending时申请Advance Parole没什么大
用。
Still need a valid nonimmigrant visa, may use it for personal or
family eme
rgency while 485 pending, doesnot guarantee reentry
如果是h1b或者h4，可以不用申请Advance Parole，这个很明白的说了。不管有没有AP，
按理说都要valid nonimmigrant visa 进美国。所以还是要去大使馆签证。
如果是F1 回国，申请visa时又不能有移民倾向。
看来这个AP是个鸡肋啊。
有哪位最近用了AP回国的说说？ |

There is a Board of Immigration Appeals case from the 1970's that is still
good law. It stands for the principle that an extension of the same visa
status is the government's endorsement that your status is and has been
lawful. The USCIS always has discretion to approve an extension of
nonimmigrant status, and if they exercise it, then it has the effect of
endorsing your continuous lawful status-- in other words, your nonimmigrant
status becomes unbroken again. |

以前工作情况, 原话是：

your last lawful admission to the U.S. on 07/31/2010. Please also submit
evidence that any and all employment since your last admission has been
authorized by USCIS.
她的情况是：两次申请EAD， 第一次是OPT，有效期05/13/2012到05/13/2013， 工作情
况如下：
Jan. 2010-Aug. 2012， Research Assistant， xx University
Oct. 2012- May. 2013， volunteer，挂靠
第二次EAD就是和485一起申请的，现已用EAD正式上班了。期间的情况是：

RFE有2个问题，第一个问题是婚姻真实性的，之前见版上很多人提过，我们也按照要求
在准备材料了。第二个问题是有关我opt期间的疑问，这个opt是我master的opt，之前
本科时也申过一个。递485的时候只交了opt复印件，paystub什么的，当时没交i797因
为最早的opt那个找不到了，所以索性就都没交。
uscis的信上具体是这样写的，希望大家给我参谋参谋，看看我都需要交什么。还有用
不用写个信具体给解释一下？谢谢大家！！！

这个月终于把485递交上去，现在在等485结果，终于有点空写点东西了。
我是去年5月来到美国的（之前也在美国读书工作，后来去别的国家了）。
因为是第二次来美国，所以知道绿卡的重要性，一来就和律师联系。我找的是mitbbs上
的四月mm, Aprilsummer，律师负责写推荐信和PL，所以比较合适我，因为我刚换这个
新工作，时间要花在新工作上。
我的文章和引用都够，开始时主要差审稿。所以准备好律师要求的材料后，到处要审稿
。主要是向老板，朋友，以及mitbbs要。这里要感谢我的老板和朋友，已经mitbbs上的
朋友们。而我也向编辑要审稿，好像没多大效果。
最后审稿上去了，以及有了媒体报道，我是通过递交纸质的140，直接PP。一周approve。
申请的过程中，我觉得律师的作用是有一种鞭策力，特别适合有拖延症的人。另外，只
有自己对自己的研究最了解，所以律师写的推荐信自己还是要再作些修改以适合自己。
PL的话，我基本就是挑些小毛病。
