1. 因为我去年OPT九个月，H1B三个月，所以看版上说要填8843来证明自己为何要用
1040NR-EZ，顺便申请5000免税。可是8843上问 "1b. Current nonimmigrant status
and date of change",可是我current status不是nonimmigrant啊，是H1B，这里怎么
填？？另外，我还要装成是学生来填“Part III students”那一栏吗……怎么觉得这
么怪

另外H1-B的“Consulate Issued”是哪里呀？
8位的Number在哪个文档中能够找到呀？

I129 petition. 刚刚在https://egov.uscis.gov/cris/Dashboard.do上查询到学校给
办的I129 petition还处于"Initial Review"的阶段,并且说"On June 9, 2010, we
received this I129 PETITION FOR A NONIMMIGRANT WORKER". 请问这个一般要多久才
可以批下来,有没有什么办法可以加快进度(比如交钱).
另外,朋友offer letter的开始工作日期是8月1日,眼看连签证可能都赶不上在这个日子
之前了.在这个日期之后签证或者拿到签证入境美国,会有什么麻烦么? 那么如何处理呢
?比如: 需要和实验室协商修改日期么? 如果现在修改offer letter 的日期,会对上面
说到的i129 petition产生什么影响么?

我是持有J-1签证, 申请的是EB1A的type, 我的J-1 waiver已经弄好受到notice了, 但
是好像跟这个Form I-797A不一样. 我能够用J1 的2year home rule waiver notice 来
替代这个不知道是什么的材料吗?

本来对于使用AP没有任何疑问，可是刚才律师说这个是个灰色地段，用了AP会影响H1B
status。因为如果是用AP入境，入境的时候海关会给一张新的I-94，上面写的是AOS（
有效期是一年），I-94是我们在美国合法身份的文件。换句话说一旦用AP入境，我们就
成了patrol status了。将来如果要延H1B，就拿不出有效的I-94了。

USCIS的memo给他们看，只要我不换雇主，我可以继续合法工作而不用ead。同时我告诉
他们我已经收到了绿卡。他们马上又说我没有及时update我的i-9，所以已经违反了联
邦法。我告诉他们我刚刚拿到绿卡，现在告诉了他们并且愿意update我的i-9。
可是因为他们再三的无理取闹，我不想让他们如愿scan我的绿卡，我说要用我的驾照
，SSN卡和A#来update我的i-9，因为这也是符合要求的文件。可是他们不愿意，只肯用

不是关于绿卡，而是关于工作签证的，第二部分是关于EB类的绿卡，不过这个法案并没
有增加EB类的绿卡名额，而只是允许提前交I-485(交500美元处理费)和签发有效期为三
年的EAD和AP. 这实际上是个很moderate的改革，可惜当时没有通过。现在把法案贴出

昨天知道140批下来, 就准备赶紧周一递了。
材料不少是重的，因为担心审131/765的部门顺手从485里抽走一些文件，所以大部分是
一式三份
下面是我整个checklist, 打算寄一个包裹，其中6个folders， 主／副申请人的 I-485
/I-765/I-131 各一个folder.
请大家帮忙看看，有没有什么遗漏的。 最近要交485的小伙伴大家也一起琢磨琢磨～～
注：看到485表上把主申请人和副申请人叫做"principal" 和 "derivative" applicant
, 所以就沿用了。不知道是不是准确？
打算folder外面写上 FirstName LastName (principal applicant), I-485 and
supporting materials 类似这种, 再加上一页checklist，希望到时候分拣材料的人别
搞错了
另外， 因为暑假正好要换工作，只好提交现任和下任雇主的 job offer letters。
