具体每个州的规定最好是直接去看那个州具体的条文和案例。
很多州都有dog-bite status, 规定狗主人要对自家狗造成的伤害（不一定是bite）付
责任。基本来说，只要是狗对别人造成了伤害，不管主人当时是否试图阻止，都要付责
任。而受伤者也不用去举证狗主人做错了什么。
比如，明尼苏达的规定：
If a dog, without provocation, attacks or injures any person who is acting
peaceably in any place where the person may lawfully be, the owner of the
dog is liable in damages to the person so attacked or injured to the full
amount of the injury sustained.

rebut，并不是说negligence per se = negligence。没有对方酒驾，需要plaintiff证
明对方negligence，有了酒驾，对方需要证明他没有negligence，这个negligence per
se实际是把球踢给对方，并不是silver bullet，一提negligence per se就万事大吉。

Was the assistant negligent? (suit against doctor under vicarious liability,

我根本就没有要证明negligence。我只是证明谋杀。
negligence是另一个话题，negligence就是该不该把孩子fasting，fasting的时候是否
确保孩子健康。42小时没有记录，不给东西，这些足够证明医院疏忽了。
可是该不该fasting也是有根据的，其中一条就是要看newborn screening data，这个
数据在州政府，
resident doctor 要了一次，州政府只给报告没有给数据
resident doctor 又要了一次，州政府还是只给报告没有数据
然后大概下午要下班了， icu主治早早就溜号不在了，几个女医生站在床边说一定要决
定是否fasting,得靠她们决定，icu主治不在。最后应该是没有收到，assume normal
就是漏洞大得海了去了。。。 出事故杀人。
我还是劝大家一定看清清楚楚我家的故事，各个医院问题差不多。别指望你有钱就能看
病， 靠社会地位！
哪里看不懂随便问。都有证据，州政府发了两次的信都写给我了。 |

发帖数: 17 | 48 简单说说车祸过程：我绿灯右转，对方在路口对面左转，和我进入同一路段，我们都要
进入同一条lane，因此发生碰撞。
双方保险认定：因我只有单保，我的保险公司不会赔偿自己的车的损失，所以车祸后我
向双方保险公司claim。
我方保险公司认为双方各50%责任。对方认为是我的责任（所以早早来信通知我，他们
的投保人没有责任，不会赔偿我），也不认可我方保险公司的认定，所以提出第三方仲
裁。我对我方保险公司的认定也不满意，我觉得至少对方责任更大（因为对方左转）。
现在，我方保险公司来信，回复赢得仲裁，仲裁机构认定对方proved 0% negligence
on our part。并且这一仲裁结果是Arbitration。 我方保险公司不需赔偿对方，并且
close了这个claim。
我的疑问是，如何理解仲裁结果对方proved 0% negligence on our part？那是否意味
我没有责任？我是否可以向对方申请对我的赔偿。

发帖数: 139 | 49 你的情况属于万幸，但是想告toyota或者dealer基本没有希望。
这件事情属于dealership的"negligence"，但你没有出任何事故，所以就没有可能要求
人身伤害或者财产损失。
你唯一的损失就是车辆可能受损。但是大部分州的法律对negligence都要求给
dealership再修理弥补过错的机会。所以你的车受了什么影响，只要这个dealer给你修
好了，同时给你了loaner/rental car，那你就没有任何法律的筹码了。
除非，你能证明这件事情不是dealer的negligence，而是toyota的recall中的弥补方案
有缺陷，导致了这件事故。但就算你告赢了，你没有什么实际损失，所能获得的赔偿也
很有限。
对于你而言，最好的结果应该是把你的车在这个dealer这里trade in，要求dealer给你
高于市场价值的报价。如果是很新的车，要求dealer给你免费换车。你要想达到这个结
果，恐怕就得做好准备和dealer扯皮。BBB很管用，可以在那里投诉。并且可以找本地
