刑事责任，对此也有各种不同结果的案例法，包括用第一修正案言论自由来为被告开脱
的。
仅仅告疏忽罪，negligence，这个可是他们自己已经道歉承认了的说是不应该把视频播
出，我们可以说是稳拿了，可是这个应该不会责任大到可以要求ABC的accountability
，要求某个负责的人被行政处分。而且得到的赔偿会很小。
所以，在疏忽罪，negligence之外，还需要加上一个重要的指控，最可行的就是我已经

下面根据本人学习TORTS中有关诽谤的内容，给出该案的举证责任分析:
1、习惯法上的举证责任：
美国的法律是英美法系，因此，过去的案例对以后的相似法律具有约束力。根据习
惯法原则，被告有举证责任，证明相关言论是真实的。如果博讯的言论涉及的是一般的

现为种族之争。
就在昨天，美国时间2月20日，似乎一向在这个移民之国中显得安静隐忍的华人群体，
却爆发了一次声势浩大的游行：全美三四十个城市的华人走上街头，声援一位被宣判为
过失杀人罪名的华裔警官——梁彼得。
梁彼得，一位在纽约供职的华裔警察。2014年11月，他与同事在巡逻一栋公寓时，在黑

欲动是何其明显，突尼斯已经基本成功，老大哥埃及也顶不住了，在中东的沙特好像也
有异动的报道。
突尼斯，埃及，沙特这些国家有一个共同点就是经济相对稳定，发展势头也不错，民众
相对富裕，整个社会已经稳定发展了几十年了，但是政治就比较保守，最明显的就是国

臉書（Facebook）因為網站上出現呼籲對以色列發動「第三次抗暴(Intifada)」的頁面
，網站與創辦人查克柏格1日挨告，並遭求償逾10億美元。
臉書本周關閉有將近50萬粉絲的「第三次抗暴」網頁，但在華盛頓提出的訴訟仍指控臉
書「失職」，未迅速回應要求移除該網頁的籲求。除了求償外，訴狀也呼籲法庭禁止臉書
「允許『第三次巴勒斯坦抗暴』或其他主張暴力網頁的存在」。
根據科技部落格TechCrunch取得的訴狀副本，向華盛頓高級法院提告的克萊曼在訴狀中
自稱是猶太裔美國公民，「積極關注以色列和全體人民的安全」。
克萊曼也自稱是政治宣導團體「自由觀察」的創辦者，該機構宣稱致力保護隱私、自由
言論和其他權利，以及協助美國主權「對抗恐怖主義國家掌控的無能聯合國」。
