教授的主页和教学行为是公开的。学生评价给的链接是教授的主页，讨论的内容是该教
授的职务行为。这里面学生完全可以argue教授在教学和科研领域属于public figure。
于是教授告学生，需要：
1. 证明这个ID是学生本人
2. 证明学生说的facts是错误的（必须用external facts证实，同行评议属于opinion
，不算）
3. 必须证明学生知道自己说的是错误的（即曾经将这些external facts给学生看过，
必须证明学生确实看到了，必须证明学生的确理解了）
4. 必须证明学生发帖是恶意的（malice），而不是督促faculty进步的善良动机。
如果3和4证明不了，alternatively，教授必须证明（show convincing evidence)学生
有足够的机会了解到自己的陈述是错误的，而且学生recklessly disregard the
falsity of the statement.
无论malice，还是recklessness，举证的难度堪比登天。

传播虚假信息的心态有三种：
第一种是明知道消息是假，还传，这个不用说了，肯定造谣；
第三种是觉得消息是真，但消息实际上是假的，这个不算造谣；
你只说了这两种，但却忽略了通常来说最关键的第二种心态，就是
不知道是真是假，但不在乎，还是说了；这个的英文叫做"reckless disregard of
truth "。在法律里面，reckless经常和intentional放在一个档次上，比如说诽谤，比
如说伤害罪，比如说谋杀罪。
我们拿谋杀罪打个比方：
第一种情况-你明知道你的枪里有子弹，你还对人脑袋开枪--没有特殊理由的情况下，
这就是故意杀人--也就是谋杀。
第三种情况-你本来以为你的枪里没有子弹，开玩笑地开了枪，结果人家的脑袋开了花-
-这个一般来说就不是故意杀人，谋杀罪也就不能成立。
关键的是第二种情况，就是你从地上捡起一把枪，你也不知道里面有没有子弹，但是你
就觉得好玩，就朝人开枪，把人脑袋打开了花--大多数情况下，这种犯罪心态（法律中

1、习惯法上的举证责任：
美国的法律是英美法系，因此，过去的案例对以后的相似法律具有约束力。根据习
惯法原则，被告有举证责任，证明相关言论是真实的。如果博讯的言论涉及的是一般的

据台湾媒体报道，日本视觉系摇滚歌手GACKT日前参加富士电视台节目《TOKIO KAKERU》，自曝从26岁起就再没吃过一口白米饭，原因竟是当时为了祈求单飞后发展顺利，才决定不吃米饭，至今过了17、18年了，他还是坚持不吃，忍耐的毅力令人佩服不已。
GACKT1999年退出视觉系摇滚团体“MALICE MIZER”单飞，他表示当时认为若不将喜欢的东西先放在一边，单飞活动恐将不顺利，由于他最爱吃白米饭，因此当下决定戒掉吃白饭的习惯，即使到现在已过了将近18年，他还是没考虑破戒。他也表示自己一天只吃一餐，早上一定要有1小时的时间喝咖啡，这段时间绝对不能被打扰。
“TOKIO”成员国分太一问他：“你现在演艺事业已经成功了，应该可以吃了吧？”没想到他竟回说：“我还是不太满意，所以还没打算吃。”
山口达也问他何时才考虑把白饭吞下肚，他酷酷地说：“快要死之前的最后一餐，应该就会考虑吃吧？因为要再次回味米饭在嘴里咀嚼的感觉。”一番话逗笑全场。

章第一节（共8页，276页至283页）。结果与上两次考证（分别为第八章第五节——共5
页，298-302页；第七章第五节——共8页，266-273页）完全相同，这三节都来自Blum
一书。本节除了两段，所有内容出现在Blum一书。小女子本乃幽默之人（看本人的第一
篇就知道了），可是，面对这样严峻得不能再严峻的事实，已经幽默不起来鸟。
仅以小女子的这三篇考证，朱学勤抄袭一事，到此可以铁板钉钉了。这还不
包括Isaiah和邢玉思两位大哥的指控。网上有朱粉这样辩解：“像这类外国历史的出处

lesser protection. But that doesn't mean they are not at all helped by the
law. Public figures can as well recover damages from defamation, though they
need to prove an additional element: actual malice.
By the way, not all celebrities choose to become public figures voluntarily;
some of them just happen to be in the spot light.

际恶意(actual malice)，这是个很高的门槛，他告不赢的。

这回去俄罗斯七天，去了圣彼德堡、莫斯科、斯摩陵斯克、沃罗宁日四个地方，前
天刚回来，感觉中俄罗差距实在太大了。
