I know several were laid off last december or january because of the 3-month
visa check in spring. They worked for less than 1 year. I went to China for
business in early december 2008 and came back in late March, then I was
laid off 2 months ago. Lots of things changed while I was not there. I am

You had to learn a lot, but the jobs in this area are fewer than other areas
. You have to code a lot, but your salary will not be higher. The only
benefit is once you are hired, not easy to be laid off, but after years,
once laid off, it is very difficult to find another one.
Foreign people can not join DOD related companies, but the major jobs of
this area are in DOD. |

for free? Hell no, if I were you, I'll spend minimum time on the work
(and that's what you are doing) and focus on job hunting.
Just say you are laid off, and if they really want, sign you as a contractor
and you can work for it.

电话面试都说自己was laid off, 然后居然都拿到下周面试和接下去的电话面试。所以
诚实真的很重要。
不知道律师会和公司怎么说，但是律师对我的case反应很平淡，我说我f2 pending,他
问最后一天工作哪一天，我说了，还说我就是那天file f2的，他也没问是否laid off,
马上说他会在petition中加上我f2 pending, 我把f2 receipt寄给他就好了。我问能否
如期工作，他说没有问题的。然后后面我马上给他寄f2 receipt,他还很客气地回邮件
谢谢我,说他今天已经file我的LCA.

Make sure you are covered with insurance. If your husband has insurance, you
can change to his now. If not, use COBRA.
P.S. Being laid off from a position has nothing to do with your capability/
performance. That is what is cruel about American work culture - Workers
are counted as "resource". So, you don't need to be loyal to your employer

基本上失业救济依赖两点，你是主动离职还是被动离职，失业期间是否actively找工
lz的case要看hr，如果hr愿意把你处理成被动离职laid off（我个人感觉fired其实应
该也有unemployment可以拿的）你应该就能拿，网上搜 具体州名加unemployment条款
就出来了，看清楚后找hr商量
要是fired好像不能拿到unemployment package,只有laid off才可以。 |

HR suggested me to go to the goverment and get unemployment benefit. I'm the
only non-citizen employee in the company, I guess the HR doesn't know
whether I'm eligible to get unemployment benefit. But if I'm eligible, it
would be a very good thing. Does anybody know? Has anybody had the similiar

left on your current H1B will remain valid.
Retrogression is not the worst case. The worst case is you may get laid off
without warning -- don't say your employer never laid off people, anything
could happen in this kind of economy. If that happens you can still save the
PD but all other efforts are down the drain.
You can always extend your H1B by one year or three years based on approved
140.

我觉得pjiang说的是公司在申请140和个人在file485的时候是否真心的想建立和保持雇
佣关系。
这在后来是可以改变主意的，当然不能太快，这就是180天的原因。但是有时就是很快
，公司倒闭了，或是股东自愿终止公司，或是公司把某员工laid off。我觉得情况是一
样的。
pjiang明确180天内说laid off没有太大关系，找到下家就好。这里也明显没有future
职位啊。
当然，我也不知道pjiang的水平有多高，只是他的文章看起来都非常合理，有solid的
东西支撑。

槽，只要雇主不撤销140，它就还是有效的，因为 140是 for future job,而不是当前
的，以后只要过了180天，就符合 AC21，而不怕 被撤销了。

If so, and if you don't have greencard and on H1, ask the company, would it
be possible to do you a favor and keep you on pay roll for some extended
time? (I did so 3 years back when laid off, the HR lady is nice enough to
extend me on payroll for 2 extra months, which helped me a lot in job
searching. )
