,心里很没底,现在被RFE了,心里更加没底.眼看还有2周就到了回复的期限, 有点焦虑,
心想自己在那里 鼓捣的也不知道对不对,不如上来请教一下看看各位老师的意见. 如果

先简单介绍一下背景, 不强,大家别见笑.
三流美国学校的生物学PH.D., PH.D期间发了7篇文章, 4篇是第一作者.但是IF都不高,
都在4~5 左右或更低.
现在在一所还过得去的大学当博后, 研究的方向和读书期间完全不同. 2年间发了一个
第一作者,一个第三作者. 第三作者的那个文章分量稍重一些，一年里有12个引用.第一
作者的那篇一般,因为是今年6月才发的, 目前还没有引用.
所有的文章加起来引用有40 次. 没有得奖. 只有AACR 的会员.
可能是我第一次递交140写petition letter的时候太马虎，没有好好把事实陈述清楚，

There are 3 code sections that govern when lethal or deadly force may
lawfully be used.
1) Defense from a forcible felony: A person is justified in using threats or
force to the degree they reasonably believe it is necessary to stop another

发帖数: 836 | 39 说实话，楼上都没说到点上。楼主的问题，其实要分开两部分看，一部分是自卫问题，
一部分是持有武器的合法性问题。
自卫的正当与否，跟你用什么武器没关系。如果陪审团认为你的自卫是justified，那
么用枪也好，砖头也好，啤酒瓶也好，都不影响自卫的正当性。所以只要法庭判你是正
当自卫，就不存在伤人的问题。
在正当自卫的情况下，伤人和weapon charge通常是分开的。比如你没有CCW在纽约揣把
枪走路，这时候来了五个身体强壮的年轻人，把你往死里打，你掏出枪来还击。基本上
在法庭上，陪审团一定会判你是justified self defense，既然是justified，那就没
有伤人的问题。但是与此同时，你几乎肯定会被起诉非法携带武器。
有些州，如果一个人使用武器进行justified self defense, 比如还是上面的情况是可
以waive firearm charge的。比如你没事冲进枪店，拿起把手枪来打一枪，在所有的州
都违法。但是假如有人想要你的命，你走投无路抢过一把枪把他打死，在很多州都是合
法的，不光自卫的部分合法，拿枪的部分也合法。

I have the urge to declare my sanity and justify my actions, but I assume I'
ll never be able to convince anyone that this was the right decision. Maybe
it's true that anyone who does this is insane by definition, but I can at
least explain my reasoning. I considered not writing any of this because of
how personal it is, but I like tying up loose ends and don't want people to
wonder why I did this. Since I've never spoken to anyone about what happened

其实呢, 我没有丝毫谴责shelter的意思.
我参与这个讨论, 只是因为我认为没有规矩不成方圆, 所以对
一些事情的细节规则有点叫真而已.
比如, 我知道很多州, 都有法律针对对动物的"unjustified killing".
对companion animal的法律就更严格.
那么shelter里的安乐死, 是专门有法律允许他们这么做呢,
还是这个被认为是"justified killing"?
如果是后者的话, 我认为这个法律就有问题了, 因为它的解释
可以有很大的自由度. 比如, 你可以认为保持生态平衡就可以justify这个,
别人也可以认为我们无权为了保持生态平衡就直接去处死这些动物.
往反方向说, 你可以认为毒死流浪猫是不对的, 可别人也可以说
流浪猫严重影响了他们自己的生活, 所以可以justify.
是不是各州有法律, 把这个"justify"的权力交给shelter来行使? |
