要么法官recuse sua sponte,要么一方上motion。lying trump要是觉得在法律上这个
coi成立，就不用whine了，上一个motion就算是denied了也是上诉的最佳理由，end of
story.
其次，所谓COI的理由成不成立？或许lying trump 这个理由可以骗poorly educated的
达克，骗不了其他人。

Judicial disqualification规定主要在28 usc 455. 455a实践中容易一些，455b举证
责任非常严苛，除非有compelling evidence证明特定的impartiality，否则压根没戏。

行政分支里头有个 Department of Justice，美新版（包括我自己）常把它翻译成司法
部。如果你去查字典，judicial, justice 都可以翻译成司法，但在这两个例子里，「
司法分支」与「司法部」是截然不同的东西，都翻译成司法显然不宜。
所以我觉得台湾的翻译比较合理：台湾有个司法院，对应美国的司法分支；行政院下有
个法务部，对应美国的 DOJ。这样把司法与法务分开，比较清楚。所以至少以后我会改
用法务部这个翻译。
法务包括执法、调查、检察，但不包括司法。

，「司法分支」与「司法部」是截然不同的东西，都翻译成司法显然不宜。
