但是死刑这个东西是非常特殊的。If I am correct, 就算在美国，最后也是要州长---
行政部门---拍板才能执行的。所以单单从元首是否能给死刑豁免来看看不出中国的
judicial independence比较差。当然你可以说提前给死刑豁免比较过分。另外，中国
的judicial independence有待提高也是从所周知的，不需要赖的律师明知故问。 |

楼主说以后打算去firm，那第二年怎么做judicial intern啊。绝大多数毕业后去firm
的，都是第二年暑期做summer asso以后拿到的offer，你第二年暑期不去firm，想毕业
以后去firm就很难了，因为作为3L interview的机会非常少，firm给3L的位子也有限，
这还都是往年的情况，更别说今年明年经济这么差了。
如果打算修课的话，前后有一段空挡还是可以做点事情的，比如说做judicial intern
，不过面试后期就要跟人家说清楚，所以要早做打算。 |

本来民主政治就是天下大乱吵而后治嘛。8-）
偶跟老墨的想法差不多，这个不至于天下大乱。第一是
双方都可以多花钱，第二花得多了还会有反效果--选民
对抹黑广告的反感这几年已经很明显了。
而且从这个案子的案情本身来看--就是一个非赢利机构
拍了一部有倾向性的电影，偶是看不出来根据第一修正案
有啥理由不让人家放。
偶看到的反对评论说这个是judicial activism，因为
推翻了一百年的传统。问题是只是推翻案例并不能
成为activism，不然就象ROBERTS写的，今天种族隔离
还是常态。真正的judicial activism是不顾宪法本身的
条文--比如第一修正案，所以从这个角度，当年的
Austin判决activism的味道还更浓一些。 |

3）周末一个家庭带着孩子去grand parents那里，grand parents早早做好一桌菜等待

尔．戈萨奇（Neil Gorsuch）为大法官。49岁的戈萨奇，若能顺利通过国会参议院审核
，则会是25年来最年轻的大法官。
去年2月，保守派大法官斯卡利亚（Antonin Scalia）过世后，联邦最高法院法官一席
悬缺至今。其余八位大法官立场明显，自由派与保守派各有4人。因此川普提名的大法

也在很早期非常巧妙的确立了
还有就是美国并不是真正意义上的民主 (democracy)
