You are using the "guilty until proven innocent" principle. For rest of the
world where "innocent until proven guilty" is more accepted, the defense
doesn't need to prove the defendant didn't commit the crime. The defense
only need to offer other plausible explanations. It's up to the prosecution
to prove the defendant did commit the crime.
So for a successful defense, all Fang needs to do is to poke hole at the
logic of the accusation. Which he did. |

In a civilized society where "innocent until proven guilty" is the accepted
standard, a suspect is not required to prove his/her innocence. It's the
job of the accuser to prove the accusation correct. |

You obviously need to learn what "innocent until proven guilty" means.
Whether a person is guilty or not does not depend on whether that person can
find evidence that conclusively prove his innocence. It's the job of the
accuser to conclusively prove that there are no other alternatives
explanations.
You can't just bring up one possibility and say that proves the person's
guilt. |

警察开车撞死一个日裔大学生，被法院判不负刑责。
这个案子，跟白人警察Nuri意外杀黑人一起，同为梁彼得案最好的案例。必须在今后的

推！做了不少研究，把有关此类枪走火的资料查了不少。讲的很有说服力。
如果再能加上muscle memory， sympathetic muscle contraction 的理论就很完整地
合理解释了梁走火的原因。各种可能的原因都包括了。基本上可以证明走火是无心之错，
这是版上哪位专业律师吧？是不是可以加入梁律师团队？

如果考虑到人的局限性，无法百分百公正，那么对于第一类错误（好人被冤）和第二类
错误（坏人脱罪）还是要区别对待的。
也就是应该宁可错放一千，不能冤枉一个。 |
