才想起来i-539上忘填做过volunteer的employment经历。(有证明信。)
表格上要填雇主信息，但是因为是unpaid volunteer所以没多想,填的No.
现在VB排期到了，律师要LD OPT期间 volunteer employment 的信息, 现在想起来，上次转H4忘了填,这样会不会被认为
非法居留H4被拒啊？
大家有听说过这样的例子吗？给点建议好吗?谢谢.

I-20上写的 on campus employment 收入为0，funds from this school是奖学金数额
，type写的是 Assistantship，这个Assistantship不算employment？

self-employed和employee是否同样受到法律保护，不能在怀孕期间被辞退呢？
我在网上没有找到相关的法律文件，在这里问一下。

May we contact your present employer? Are they aware of this application?
请问这可以写No吗？在HR看来是不是不太好呢？
我的present employer是phd老板。他放我毕业了，答辩定在五月底。但是由于以前种
种事情，我已经对他失去了80%的信任。
我会请committee和本实验室的scientist来当我的reference，他们都是德高望重的老
头，几年来对我印象一直都很好。所以老板不会是我的reference。在这样的情况下，
我很犹豫是否可以拒绝公司联系现老板？

permanent"改成了"regular".我们单位一直都用regular,没有出现任何问题。

Employment based 的，因为工资不到prevailing wage,担心公司会因此不给file 485,
所以想看看有没有什么解决的办法。
我的理解是485是属于employee的，所以可以自己file。要是公司不肯file就自己交，
employment letter 就写现在的salary,485 180天之后再换个能meet prevailing wage
的工作，有RFE的话就能应对了，这样应该可行吧？
就是不确定这样的话以什么理由跟公司要employment verification letter呢? 说在找
apartment,房东asks for it.这样可以吗？ |

HR说根据公司规定，不会开出任何含有job description的信，如果要包含job
description的话需要我的老板来签字，但是不能用letter head。
HR只给开一份简单的verification of employment,只有工作开始时间，title,
location，年薪，但是不提供brief job description
请问大家这样的employment letter能过吗？
还是需要让老板签一份和HR的employment letter一起交上去？
我特别担心会被被RFE...

我的实际操作：没有提交employment letter；后来没有RFE直接就批了。但是，移民局
向我公司打过电话，这个电话和"没有提交employment letter"有没有关系只能猜了，
也不好猜，移民局也向我的推荐人打过电话（电话都是在485审查期间）。 |

发帖数: 344 | 20 法律的条文没有严格规定，或者说有点模糊，所以移民官自己掌握，最后 case by case。大家纷纷以自己的案子为例，盲人摸象，每个人都对。我知道的实例：
（1）没有employment letter，没有rfe 直接批准。
（2）没有employment letter，被rfe。
（3）哈佛学生拿了EB1A绿卡，肯定没有employment letter。
寻根法律原条文，那是很专业的事情，咬文嚼字。CONTINUE WORK 可以是你的理解，也可以是准备拿到绿卡后继续工作，没有必要现在有实际工作或"will work" offer；也可以理解成强调必须继续在area of extraordinary ability工作。所以我们需要律师。

我有两个疑问：
1.为什么都是将来的语气？EB1B是employment-based,如果还没有employed,应该不能申
请吧。
2.一般来说申请EB1B，Employment Verification Letter需要说明两点：a)这个市永久
研究职位，b)本公司有不少于三个全职研究院。你给的sample根本没有提第二点。

问题是我submit 485的时候已经交了一份EVL了阿，HR在寄材料前一天签的
RFE信里要求
"The letter must also indicate whether the terms and conditions of your
employment-based visa petition (or labor certification) continue to exist"
这个在原来的EVL里没有提到，也许就是这里被RFE了

2.最稳妥的处理:到新公司后再申请485;
比较稳妥的处理:提交现在的employment letter, 并附短信及新公司的offer letter
说明你的实际情况;这时最好说清楚新公司的联系方式,以便移民局确认.移民局想确认
又确认不了,就找你要RFE,会耽误时间;
最简单的处理:不提交employment letter.(本ID未提交,无RFE绿,但移民局曾打电话
去公司落实有关表格上填写的雇佣信息)

里面有工作开始时间，职责，工资福利等内容
但是没有写H1b的结束时间（我的H1b到2016年1月，但有可能今年2月底就没funding了）
结果是系里签的（HR说系里签比较合适）
现在申请485是不是能用同一个employment letter
还是要让HR再签一个employment letter
不是最近的会不会有问题？
