file the same form, if "approved" it will not be asylum category (which is a
valid GC eligibility category) but withholding of removal, which only gives
you EAD but nothing else (no basis for I-131 or I-485, and this temp
protection status will be canceled if you leave US)
"approved" has quotation mark because in fact it is a denial of asylum, but the deportation accompanying with the denial of asylum is withheld. |

Basic background, I submitted my RFE without adding my case number (My
mistake. I originally planned to photocopy the RFE letter since both SRC and
A numbers are on the first page, but right before submitting the RFE, it
was found that only the yellow page was required. I did not notice that
there was no SRC or A# on that page, stupid!!)
After less than one week, I received the message that my case was denied.

Something I've been meaning to do for a while was check what proportion of
PP RFEs get an approval or denial. A lot of people on this site say "don't
do PP as you'll get a RFE" which is irrelevant because what you want to know
is whether you'll be ultimately approved, not whether they ask additional
questions.
By my reckoning using the stats on this site (all I-140):
6% of PP with RFE get denied
10% of non-PP with RFE get denied

，你的却好多了；
不知道你的case 是不是DIY，是不是pp,我的是DIY+pp,现在在重新准备，发现以前file
的推荐信和petition letter把自己描述得比较的嫩；1172没有怎么看petition letter
,他随便找的几个借口就能把人整死。
其中我的那个award，我没有把它claim，只是放在contribution里面，他拿出来说事了。
建议是：推荐信千万要弄好，感觉上要万物一失，让人无懈可击；他在我的denial
letter上还讲到了rfe前的几封推荐信，也只能怪自己当初没有准备好吧，我以为只要
提交几封好一点的推荐信就万事了，他不这么认为，在denial letter里面他把所有的
推荐信一起拿出来说事，而不是像rfe那样很rough的给你几点。

After you get GC and spouse's I-485 is still pending, he/she is AOS.
If I-485 denied, he/she will become illegal.
(1)可否再次提出申请？
depending on the reason of denial.
(2) 在此期间，H4是什么身份啊
you have GC now, so H4 is gone and only AOS is good if I-485 is pending.

发帖数: 7030 | 13 大概情况如下：LG EB1A 140批了以后，我和LG同时提交485,LG还递了AP,我递了AP+EAD
申请（我当时还是F1状态）。同时因为临近毕业，我在学校ISO也提交了OPT申请。
结果LG AP被批准，我的EAD申请被RFE了，收到RFE之后发现765表填错了，485-EAD申请
的category应该是c9,结果顺手给填成c3a了。。于是赶紧补了张正确的765表，顺便把
485申请的号码和Receive notice一并寄了回去。这段时间里学校的OPT也批了。
今天网上状态突然变成了EAD denial，还没收到原因，大家帮忙分析分析可能是因为什
么呢？denial之后还有什么补救措施没？会不会影响AP和485批准呢？谢谢了！ |

为大蜜经手的RFE或者说NOID 还是出现了一例denial.过去2个月里，大蜜共审阅了近20
份RFE,其中目前已经通过的11份（TSC 8, NSC 3)，被拒的一份，仍然正在准备回复的9
份。(这里补充一下，这并非是大蜜的功劳，大伙都是人群中出类拔萃的，往往只需要
一点就通了。） 第一次出现denial,是在上个星期。 大蜜不说，大家也可以猜到，来

NOID. 其实大蜜也非常希望能够挑战NSC 0002 NOID成功， 开创先例。 但是根据目前

的 都最终在承认了三点，(authorship, review , contribution) 的情况下，倒在了

approved case. So IOs find that one case will issue RFE or denial, he might
hold it for a while until he has time to prepare the letter.

Today when I checked the EAD status: "we mailed you a denial decision notice
for this case I765 APPLICATION FOR EMPLOYMENT AUTHORIZATION. The notice
explains why the denial decision was made and the options that may be
available to you. "
Is it normal? What should I do when I receive this mail (just ignore this
notice)?

I-485 is denied. If denial is due to something like leave US before AP
approval, the I-130 is still good. |

who said that? If it's USCIS COS denial (I-797 denial notice), you have to
leave US and get a visa stamp to return. If it's your company, find another
job that will sponsor your H1B. |

proceeding and immigration court. Not the usual EB based denial outcome.
If your marriage is true, then you will eventually get GC even after denial.
Filing 2nd I-485 is absolutely useless in your category. |

客户出具，然后这个某大公司的legal department幺蛾子不断，说起来都是泪）。今天
公司无良律师终于失去耐心，把那封信连带项目一块从我的application package里面
除去了，大概30%的比重吧，还逼着我马上PP，因为想在四月一号之前知道我是不是需
要file H1b （mlgb就算现在pp两个星期后被denial也来不及准备H1b啊！）我tm的case
本来就不强，这么一折腾再pp，不是作死么？跪求兄弟姐妹们给个祝福吧，只要不是
denial，rfe都行啊，眼泪哗哗的。 |

11/21 收到 denial email:

an extreme emergent need, which must meet one of the following criteria:
11/21 打电话要求接线员转IO，IO说让附上offer letter and current HR

发帖数: 78 | 24 公司现在在帮我办Eb1b，应该没几周就会交材料了，但是公司律师说不搞pp因为他们根
据经验pp会增加被rfe和denial的机率。我自己其实不是很急了，但是我老婆现在准备
quit掉phd然后工作，她刚拿到offer（我在apple，她拿到了google），但是她现在没
有opt所以只能先用cpt上班，summer至少没问题，但之后就不知道了，因为怕系里不让
她接着用cpt因为毕竟都想quit了。
所以我有几个问题：
1）是不是pp会增加被rfe和denial的概率？
2）我能不能让公司140和485一起交？我看网上说可以但不建议。因为似乎485提交之后
就可以申请ead了，有了ead我老婆上班就没问题，即使cpt不能用了。但我不知道这个
会不会有什么风险之类的。
3）怎么才能最快地让我老婆拿到ead。
我的case不是很强，eb1a律师都不接的。我7篇paper，四篇是一作，没有citation，50
次review，两个journal的associate editor，一个conference的committee member，

节前一周提交直接pp，节后上班第一天晚上查状态显示approved。
之前有过一次denial的经历，又是直接pp NSC，本来是做好了RFE的准备，没想到直接
approved.有点喜出望外，昨天一直很high，现在才平静一下上来报告这个好消息，也
总结一下这两年的经历，希望也给大家带来一些好运气。
从2013年1月开始联系律师到现在一共两年整的时间，中间经历NIW approvel, 1st
Eb1a RFE, EB1a Daniel, 2nd Eb1a refile and approve，再加上工作和生活的变动，
非常辛苦，主要是精神压力很大，现在回想起来都不知道怎么挺过来的。anyway非常庆
幸自己有勇气去尝试并最终坚持了下来。

EB1了，律师非要办EB1A，说EB1b麻烦，没说服他们，同意file EB1a。看到pention
letter时发现和O1几乎一模一样，都claim了同样的5项。推荐信也是全部一样，一点没
改。3封独立（英国，中国，韩国）3封非独立（都是美国，以前老板们）。
RD 1/6,PP receipt 1/4, RFE 1/12,今天收到邮件通知，律师可能还没收到书面的
letter，已要求律师收到后给发给我看看。
背景：交通工程Phd，在国家实验室工作了一年半，现在一家IT公司做研发。文章数(17
)：1篇book chapter，5篇journal，11篇conference。citation：Google scholar 57
，将近一半来自自己一作或N作。审稿：92篇，一半好期刊一半烂的。无奖无报道（有
报道但没提我名字，所以就没去claim）。
律师是公司指派的F家，感觉全在套模板，RFE自己要好好准备下，祈祷一切能顺利。

发帖数: 36 | 27 其实心情还算平静，之前也已经有不好的预感，所以不算太出乎意料。自身也不够强，
不能做到见佛杀佛。
第一次submit 140之前，其实来本版的很少，很多都不懂。但是总算知道该找律师评估
。找的是wegreen家（有不少朋友私信我问律师），律师水平没有问题，速度也很赞，
术业有专攻。除非自己真的很有闲，不然自己做失败的概率也不会小。
大概讲讲自己的申请过程，其实2015上半年就想申请，但是忙着renew h1b和其他工作
上的事情，所以想干脆等h1b approve下来再搞这个140.所以一开始不是特别主动，9月
跟律师签了合同，research summary拖了1个月才交上去。
然后就是找推荐信，所以说之前没有太上心，这里找独立推荐人也有体现。我觉得找直
接引用我文章的人比较好，所以就在自己文章引用里找老中，通过自己的关系，直接电
话搞定推荐信，当然都很顺利，3个推荐信都是老中，但都是引用了我自己的文章。
非独立的找了美国之前合作的一个美国教授，也是department head。

律师：If you reenter the US on your AP, your status in the US will be “
pending adjustment applicant.” The problem with this status is that if
your I-485 is denied, for any reason, as a “pending adjustment applicant”
you are required to depart the US on the date you receive notice of the
denial.
I always recommend that faculty stay on H-1B status while their I-485s are
pending because if the I-485 is denied, they can remain in the US in H-1B

大概在15000~17000之间（链接1），这些拿到了H1b的人算上他们的家属最后大部分要
通过EB23通道来拿绿卡，这是在ICC还没有被整治时期的中国H1b的批准数量。从去年开
始USCIS开始大批增加ICC公司的拒签率（链接2），中国作为H1b的申请大户预计批准数
量会进一步提高，导致未来EB23的潜在demand还会持续增加。EB1由于排期问题，每年
至少7000（根据2016~2018年的数据做的保守估计）的demand肯定有一部分要往EB2转移
，进一步恶化EB2的排期。
这是我从数据上看到的结果，欢迎指正。

这绿卡真是拿得千辛万苦！ 两个EB1, 一个eb2，还有family case！ denial after
denial... 所以希望大家有困难也不要泄气，大家都会拿到的。
我想借这个论坛好好感谢一下皮匠老师。 我们是在老师的指导下顺利拿到绿卡的。
我对老师的评价是对移民局的操作熟透透，且认真，负责。可以说我们遇到贵人了。唯
一美中不足之处 ----- 我们是在两个月前才联系皮匠老师的。要是早知道他，我们早
就拿到绿卡了。 |

标 题: 小女子求助：H1B被拒后该怎么办

小女子这厢有礼了！
昨天我看到的H1B petition状态变为 “Decision Made”但是只说“review completed
”没有说是“approval” 还是“DENIAL”。小女子想问问，如果是DENIAL的话：
1. 我有什么补救办法吗？听说可以花钱找个烂学校挂着包住身份，然后等秋季读书或
者用烂学校的CPT拖到明年4月再申请H1B。这样做有啥坏处吗？烂学校的这个经历会影
响我以后的H1B或者绿卡吗？
2.如果我按规定回国，几个月后再以F1的身份申请进入美国从2013 FALL开始读书。这
样做难吗？H1B被拒的经历会影响我的签证吗？（2013FALL我要读的话是CS的MASTER，
以前我已经有个MATH MASTER的学位了）

发帖数: 1627 | 47 本人学业不精，permenantly head damaged，真是汗颜，现在知错就改。以前总觉得
EB23闹成这样有失体面，在于我只注意了AP的便利性（H1B也可以往返，并非生死问题
）和EAD可以让配偶工作，而忽视了EAD的另一个重要性。经过某些EB2的再教育，体会
到了为什么EB3应该全力阻止EB2降级。
其实最重要的是EAD的一项功能。根据AC21法律，在485上交180后，不仅仅可以换工
作（前雇主撤掉140也没关系），还可以在失业的情况下保住身份，重新上路。那么485
就不是所谓锦上添花的效能，而是可以和绿卡比肩了。
基于此判断，我鼓励所有的EB3使用各种方法保住自己的排期，坚决阻击EB2的降级。

我目前没见过eb3 denial的，你可以考古放狗搜一搜，如果denial了一般都会发帖在寻
求帮助的（我看过eb1的）但是eb3真是没见过 |
