发帖数: 5 | 1 周一得知自己i-140 and 485 同时批准，百感交集，顿时觉得“too good to be true"
分享一下自己的申请经验，
去年9月份公司答应办eb1b，10月开始准备材料，感恩节前后材料递到tsc。新年前追加
pp, 今年1月初收到ref。一月中旬回复ref 并递交485, 二月初被denial。之后积极准
备appeal 材料，三月初递交appeal letter, 三月底打指纹（之前因为大雪错过了打指
纹）。周一律师告之 i-140 和 i-485 同时批准，并收到welcome notice。
感谢在过程中家人，老板和公司的支持。版上蔡律师帮忙准备了appeal letter，在此
表示感谢。
一直在版上晃，学到了很多。祝其他同学申请好运，任何情况下保持乐观的心态！ |

“We also feel that you would have a decent shot at an appeal to overturn
the denial, however, the appeal process is currently taking over 4 years at
BALCA.”

Cannot Appeal and Re-File with Same Employer
Another layer of complexity in this situation stems from a prohibition
against the employer's filing a new PERM for the beneficiary while the
reconsideration or BALCA appeal is pending. A new PERM application can be
filed if the BALCA appeal is denied, or the employer may withdraw the BALCA
appeal at any time in order to file a new application.

发帖数: 947 | 14 据消息所知，在PERM系统正式使用后所收到的几百个PERM申请，基本上都是被”denied”
，而仍没有一个是被批准的案件。基本上，这些申请被拒绝是由于PERM是一个”highly
rule-based system”(所有审核标准已经法律规革系统化) ，所以对于一些申请，只要系
统在审核过程中，只要发现一些细微的错处，都可能导致申请被拒绝。其实PERM的系统里
仍然有一些technical的问题待解决。因此即便案件没有问题，仍然有可能被拒绝。 以下
为劳工部DOL所指出可能导致denial 申请的几点：
1，Prevailing Wage Determination的生效时间是在3005年3月8日前。基本上DOL要求所
提交的Prevailing Wage Determination必须是在3月8日后的(dated March 8 or after).
2， 在SWA的job order必须至少为30天以上。因为不少job order是在2月份开始的，而
这个月只有28天，所以这也是导致申请被拒绝的原因之一。
3，PERM申请须由雇主直接提交，雇主须通过其电脑进行registrat |

韩寒的文章我只读过一篇半。大概一年前，我在CND 上读过韩寒的一篇针砭中国社会状
况的文章。我觉得文章写的比较尖锐。有不少调侃的句子。文笔也不错。不过，若论针
砭中国时政，我六年前写的文章http://he-saizhang.hxwk.org/2006/06/07/">《民主理念大纲》里就有全面的批判和具体的分析。若论反共，海内外的民主志士中文章写得好的人多了。我对韩寒的出现觉得高兴。但我对韩寒实在没有高的期望。一年多来，我从来没有赞扬或批评过韩寒。
韩寒的“新三篇”里有一篇文章我一目十行地看了一下。因为是一目十行读的，我最多
也就读了文章的一半。所以我说我总共只读了“一篇半”的韩寒。关于这篇文章我就不
谈感想了。
关于韩寒文章是否“代笔”的争论，第一篇让我认同的文字是网友 TaoCi 的一个帖子
。后面读到了曹长青的两篇文章。我觉得曹写的很好。不过对于曹提出的让韩寒接受某
种“测验”的建议，我并不同意。后来我又读了网友变形金刚和水田的“挺韩”文章。
我从开始就觉得麦田，方舟子，曹长青对韩寒的质疑是正常的。
