第一， 大家要知道，无论是谁，对自己的house or apartment的使用都没有绝对的
自由。比如说噪音，city or county一般都会有对噪音控制的ordinance；如果你有

1）首先态度良好，保持要解决问题的态度。说要见board 面谈。一般见 Board很多都
好说。
2）如果HOA没有用certified mail,你就告诉他们从来没收到通知，不知道自己违规 （
信邮局会漏寄，邮件进了Spam）。
3）第一次听到，问可以不可减免罚款。估计罚还是要罚的，就是可以少罚点。也可以
分期付。
要是软的不行，仔细研究你们的covenant。首先看看HOA这个规定更改，有没有按照法
律法规的流程走，如果没有，这条规定是non- enforceable。之后，看你在哪个州，还
有你们covenant 怎么写，这种repeated violation,只要你remove的车一次，那么你的
violation就算改正了，然后他们必须每次你停车就要写通知，如果没有，那么你的违
规，他们没有按规定给你通知，也就不能罚款。

Limitations for Written Contract,

这样你心里就有底了。
但是，每个州的法律规定不一样的，有些州的covenant诉讼时效是跟房产的，有些州是
跟业主的。如果诉讼时效跟房产的，那么不管HOA有没有发信给你的前业主，只要从建
这个阳台开始过了10年（假如你们州的诉讼时效是10年），HOA都没去法院告的话，现
在他们要告你，你可以用诉讼时效已过期为理由要求法院驳回起诉；如果诉讼时效是跟
业主的，那么很可能你买房之后诉讼时效就重新开始计算了，这样如果你买房的时候文
件里有这个阳台的规定，你们没注意，那你们就只能遵守了，或者如果买房的时候有人
应该给你这个文件却没给，或者卖家知道阳台违反规定了却没告诉你，那修阳台的钱找
他们要去。
