appeal grade due to the bad group performance of that student。我说过了deadline，学

title 28 Part 25.9(b)(1),(2), 如果你appeal成功FBI不可以保留你提交的appeal文
件。这样做是出于保护个人隐私的目的，但是如果你下一次再次买枪可能还是会被拒，
需要重新提交appeal文件。
指纹卡和voluntary appeal file可以让FBI NICS保留你所有appeal的文件，这样让你

“appeal时重点强调希望送ref 3 and 4那里再审，大家觉得这个可行么？”
明显indicate这一店。
首先，你的review process有没有结束？如果没有结束，你可以要求送回Ref 3 and 4,
但是这个不叫appeal
review process结束的最明显标志就是Editor给你的信里有这一句
“This concludes our review process”
如果你见到这一句了，那么下面就是appeal. Appeal已经跟Ref 3 4半毛钱关系都没有
了，而是会送到一个DAE的手里。 DAE会得到你和referee/editor所有的communication
, 包括referee的identity. DAE会给出结论。如果拒掉，DAE必须署名，这也就是为什
么很多大牛的PRL都在最后这一步过了的原因－－－没有人愿意让这个大牛知道是自己
拒的。如果你老板不是大牛，那只能碰碰运气了。
如果是DAE拒了之后，那下一部只能PRL Chief editor了，不过这一步已经不包含任何

对于我的驾驶记录的，appeal的结果是不会影响这个 accident的结果了，只影响我来
年的保险会不会涨点，我的保险公司和对方的保险公司已经对这个ACCIDENT做出了判断
了。
AGENT还说我的保险公司的人，也就是刚开始给我打电话调查情况的人说“have her
appeal’,我就挺纳闷，如果APPEAL我赢了，保险公司岂不是赔钱了，因为他们已经赔
了我的近500刀，赔了对方的两千刀，又不能涨我的保险，看起来与我很有利，他们怎
么会做这种吃力不讨好的事呢？
还是会有什么其他的原因？
希望大家有过这种经历的告之一下。会不会有什么其他不利因素在里面。

壁车一下。由于车是我的，虽然是朋友开门蹭了别人车，并不是我的错，但貌似还是要
我负责。。。 当时走了保险。
这几天收到保险公司的来信，说他们将事故报告给Merit Rating Board，并裁定是我
more than 50％ at fault for the accident。说这个会有记录然后导致明年保费上涨
，并提供一张表可以让我Appeal （MA Division of Insurance）
请问大家：
1，这个根本不是我开门撞的，而是朋友开他那侧门撞的也是我的责任么？ （more
than 50％ at fault）
2。这种情况appeal有用么？ 能appeal掉么？
3。如果appeal不掉这个会一直留在我的driving record里面么？ （我可一直都是
clean record啊！）要是appeal掉了是
不是就不会有记录也不会涨保险？

时存的时候记不得看见了必须在今年3月31号之前file claim。这个account是公司外包
给UnitedHealthcare的。
今年年初的时候忘了这件事，公司和UnitedHealthcare也没有任何提醒。一直到快五月
份的时候我才想起来，打电话去问UnitedHealthcare，他们说已经过了deadline了，不
能要回来了。我第二次打电话的时候他们说可以试着appeal。
我就file了一个appeal，主要说我找了网上我的benefit documents，没发现哪里有

tax.有几个相关问题，想问问谁有类似经验。
（1）信里没提这个费用是否就是一年的，否则以后每年都受40%？不过也可能就是每年
都受40%减掉的部分。
（2）如果不签字参加，难道如果律师appeal成功，county只减少参加户的property
tax?这个不太合理吧，都是一个小区的townhouse,为什么会差太多？就是觉得如果小区
里的其他没参加的住户，也减少了property tax,那就没必要参加这个appeal了。
（3）还是说，如果不参加appeal,就表示接受了county assessor的估价，尽管有可能
我的邻居参加了appeal,最后减了很多property tax? |

运气实在是太差。PERM audit后被reject了。马上appeal。在这段时间因为公司关闭了
东岸的site，内部transfer到西岸。又file了第二个PERM。现在收到Board of Alien
Labor Certification Appeals的信，要求决定是否要继续appeal first PERM。公司律
师不建议，理由是由于东部的工作已经没有了，first PERM被拒的可能性很大。同时因
为第二个PERM也在申请，如appeal，有可能对第二个PERM也有不好的影响。
关键是第一个PERM的优先日期比第二个的早3年。本来还想能用第一个PERM的优先日期。
有没有人有相关的经验？该不该冒险赌一把？ |

第二次被拒的EB1A，因为我觉得自己背景不错，更关键原因是，我希望自己在appeal的
过程中可以保持身份，甚至找工作。但有两小问想求教牛人：
1）在appeal的审理过程中，我是不是合法身份？我已经交了485，拿到EAD，在最终决
定下来以前，我可否用EAD工作？
2）请问如果appeal employment-based I-140，会不会影响我之后提交的family-based
green card petition? 循规蹈矩惯了，怕一appeal，移民局一查纪录后不高兴，然后
也给婚姻绿卡申请诸多刁难。

Reconsideration to Certifying Officer. The goverment error appeals argue
that the DOL made a mistake based on their own rules and there is currently
no backlog in getting those decisions reviewed. The reconsideration to

发帖数: 533 | 35 上个月底去枪店买手枪（第一次），做了background check之后被告知denied。原因是
我提供的绿卡复印件上显示绿卡批准日期到当天不到90天，尽管我提供了90天的电费账
单证明我在这个地址住满了90天。仔细看了deny的原因，唯一沾得上边的是“Is
illegally or unlawfully in the United States”。可能他们不知道我绿卡批准前的
身份。
刚发现denial是会上record的，所以准备appeal。能不能麻烦哪位有类似经验的前辈讲
一讲appeal的步骤啊？我看NICS的网页上说他们有一个可以appeal的网站，但是没找到
。是不是必须给他们先写信问denial的原因，然后再appeal啊？可以打电话或是写
email么？我看到NICS的网页上说联系他们需要提供NTN或者STN。是不是要去枪店索要
当时填写的表格啊？另外还需要打指纹么？如果需要的话去哪里打？appeal要多久才能
通过？

去年老婆工作，我第一次存了5000的Dependent care flexible spending account, 当
时存的时候记不得看见了必须在今年3月31号之前file claim。这个account是公司外包
给UnitedHealthcare的。
今年年初的时候忘了这件事，公司和UnitedHealthcare也没有任何提醒。一直到快五月
份的时候我才想起来，打电话去问UnitedHealthcare，他们说已经过了deadline了，不
能要回来了。我第二次打电话的时候他们说可以试着appeal。
我就file了一个appeal，主要说我找了网上我的benefit documents，没发现哪里有

发帖数: 380 | 41 最近有一篇PRL被拒。这是一篇实验的文章，第一轮有两个审稿人，Referee A应该是个
搞实验的，对文章有很高的评价，提了些小问题推荐发表。Referee B应该是个做理论
的，审稿意见压根没提实验，直接说这个实验的理论有问题。但我们这个实验的理论已
经发表在PRA上，显然这个Referee的说法是很容易驳斥的。我们Response也反驳了
Referee B。第二轮Referee A还是同意发表，Referee B任然认为理论有问题。编辑然
后又找了Referee C。Referee C（已经猜到是一个实验组做理论的人）的审稿意见让人
非常愤怒。我们的实验结果比之前所有的实验都要好很多，但Referee C说之前做的实
验只要用了某个方法也可以做出我们的结果。姑且不说Referee C提的这种方法是否可
行，用这种argument来评价已经做出的实验结果是否有些荒唐？况且如果这个简单的方
法可行为什么没有人使用？Referee C接着顺着Referee B说理论有问题，却压根不提我
们已经发表的理论文章具体有什么问题。

朋友参加GMAT考试，在考试中间休息的时候，由于看到别人都在
看学习资料，于是也拿出包里的资料在走廊中看了一会儿。
在重新check in进入考试的时候，考场人员发现朋友手里拿有
几张打印的资料。就问朋友是否study material. 朋友未加思
索就回答yes. 结果被告知此情况将被汇报到gmat考试管理委
员会等候处理。几天就接到gmat中心的信，说成绩被cancel
因为take unfair advantage in the exam. 唯一的办法就是
去appeal. 大家都知道现在gmat是机考，朋友完全是为了缓解
自己紧张的情绪才拿出材料看了一下，对考试根本谈不上帮助。
兄弟姐妹谁有appeal的经验来说说看，该如何appeal成功的

上文说到如果对保险公司的处理不满，可以file an appeal。那么具体如何操作呢？
保险公司每处理一个claim，都会生成一个EOB（Explanation of Benefits），这上面
会用具体的code表示某项检查cover多少，某项检查不在保险范围之内，某项检查是否
属于deductible。最后总结出你要支付的金额。EOB上也会说，如果你对其中一项或多
项有异议，可以首先向保险公司file an appeal。那么最简单的申诉办法就是打医疗卡
上的那个客服电话，说你认为某项处理不当，根据你的coverage，他们应该付XXX。保
险公司收到你的appeal会在30天内重新处理你的claim，他们可能接受也可能拒绝。这

吗？公司非常小，但材料补充得很齐全，没想到还是拒了。在美国这几年一直为了拿到
签证而奋斗，这样的结果真是让我无比难过。
我OPT 四月中到期，律师现在给了几个选择，appeal, 重新file一个h1b, 或者开始办
绿卡。 Appeal期间可以工作，但有可能驾照续期有问题。
想问一下，现在是不是Marketing方面的职位非常难批。就算重新申请，机会是不是还
是很小？因为涉及到一家人的未来，我需要好好考虑清楚，做出选择。
现在感觉处于人生的十字路口，有点不知道该怎么办。 |

发帖数: 169 | 48 运气实在是太差。PERM audit后被reject了。马上appeal。在这段时间因为公司关闭了
东岸的site，内部transfer到西岸。又file了第二个PERM。现在收到Board of Alien
Labor Certification Appeals的信，要求决定是否要继续appeal first PERM。公司律
师不建议，理由是由于东部的工作已经没有了，first PERM被拒的可能性很大。同时因
为第二个PERM也在申请，如appeal，有可能对第二个PERM也有不好的影响。
关键是第一个PERM的优先日期比第二个的早3年。本来还想能用第一个PERM的优先日期。
有没有人有相关的经验？该不该冒险赌一把？ |
