捕。拥有物理学博士学位且与中国内地期货业交游甚广的杨春来,曾任旅美中国科学家
工程师专业人士协会(ACSE)理事会主席,目前则为该协会期货期权金融学会会长。
根据芝加哥地区联邦法院受理的起诉,现年49岁、2000年以来受雇于CME的杨春来,被
指控窃取CME的有关交易秘密。
今年5月以来,CME的保安人员开始监视杨春来办公电脑上的操作。他们发现有数千份文
件被拷贝至杨春来携带的“闪存”等移动存储设备上,而其中很多文件涉及CME的经营
机密,并载有受保护的源代码。CME还为此向FBI提供了杨春来的电脑截屏,以证明其存
在窃密行为。

上诉法院是说,偷不在市场上卖的源程序,又不是帮外国人偷,就不归联邦管,所以不
算联邦罪。你就能引申成“偷源程序不犯法”。

finding that the HFT source code did not fit within the scope of the
National Stolen Property Act (“NSPA”), which makes it a crime to transport
or transmit stolen goods, wares, or merchandise. The court concluded that
Aleynikov did not steal physical “goods” per se, but rather, software code
which was “purely intangible property embodied in a purely intangible

这哥们就是得罪了高盛。
华为和腾讯被抓的那几个。估计也是这样的罪名。
其实这个trial的最大的问题是。goldman的那个code真是piece of shit。这哥们确实
偷代码了。但是gold提出的这些code值多少多少钱纯粹是BS。
如果高盛在FBI没有关系,这种事根本没人管。不信你老中开一家公司。雇员偷了代码
有人管么?我还真认识这么一位老中。只能用civil law suit骚扰前雇员。虽然那家伙
也被搞得很狼狈,但是绝对不可能坐牢。

高科技?魏老,我,以及vanityfair的记者,这么多人都不认为是“高科技”
所谓的“高科技”,不过是GS的犹太人太贪心,想给那个员工多加一些罪,好多关几年
找的莫须有的借口而已。
更关键更关键的是,FBI的定义里面,从来没有说FBI只管高科技不管低科技
也没有说FBI只管跨州不管不跨州。
Texas这么大的命案,而且明显是有组织有预谋的犯罪,要说FBI 有理由不管,

之前看过一个书评,说的是《Flash Boys:A Wall Street Revolt》这本书。据说是一
本non-fiction book,作者:Michael Lewis,出版日期:March 31, 2014。此书被看
作是一窥华尔街高频交易的窗口。或者可以看一看。
其中一个故事讲到,一个叫Spread Networks的公司,通过铺设光纤、应用最先进的技
术来争取高频交易中宝贵的几十毫秒进行抢先交易;另一边是另一个叫IEX的startup,
通过新技术,发明Thor的算法、把38英里的光纤绕在鞋盒大小的盒子里,阻止高频交易
