约好了时间,我打过去,先问他 " it looks like you have extensive industry
background including managerial experience, what makes you interested in
applying for an entry level position?"
他答:“this position is not entry level"
me :“huh"
he: " you listed MBA in your job requirement (note: i put MBA a plus). I
think any position that requires MBA is a CEO job"
我当时就快昏倒了,我以为他会强调他以前的经历对我们多么多么的有用,以及他如何
对我们的公司和职位感兴趣。我解释MBA is not required, but if a person has MBA
but no direct experience, we can consider MBA related courses as a
substitute.
接下来他又问我们的position 具体做什么,我介绍了一下,然后他就说“i have
trained 80 persons like you in philipines, but after i trained them i got
laid off".
结果可想而知,我对他立刻没有了兴趣,虽然他反复强调他有一个5岁的女儿要养,急
需一份工作,就委婉的说我们还在interview, will notify him if there is any
further step.
过了两周,他发了email给我的同事,说他受到了age discrimination. 我的同事
forward他的email 给公司的HR, cc 我。 HR 约了明天谈。
请问被人告严重吗?和HR谈需要注意什么?
真倒霉,本来最近压力就很大了,还要多出这种东西 |

1. Did you ask his age during the interview, or mentioned anything related
to age?
2. If not, nothing to fear, just state the truth. It's just his word against
yours.
3. If you did, then is it possible that he recorded the interview? If not,
then again, it's his word against yours.
4. If he might have recorded the interview, does your state law require
consent of all parties before it can be recorded? If so, and you didn't
consent to recording, nothing to fear. It's still his word against yours.
5. If he legally recorded the conversation, and you did ask his age, then I
don't know.
BTW, you are not sued. In the worst case your company will be sued. Unless
he has evidence, there is nothing to fear.

No, I didn't ask anything about his age. I know it's illegal/imappropriate
to ask about age during an interview. What I am looking for is a can-do and
positive attitude, so this disqualified him. |

得你抢了老美的饭碗。那个被面试的人才提菲律宾人的事儿。
不过就他的指控,应该没事儿,你又没说有年龄限制,也没问过他年龄。 |

cases like this.

如果换了是我,我会直接找这个同事,问他: What kind of person you recommended
to me!And you reported his bitter claim to HR before hearing out the other

如果他拿公司policy说话,你就告诉他:Cut the crap!
当然,以上对话不能当着别人。以防你同事再次把你告到HR那里去,到时候你来个不承
认,他下次再想搞你,就得考虑考虑了

想买个人情吧,反正phone interview 也花不了那么多的时间,但是没有想到被refer
的人是这样的人,我感觉他两年多来找工作已经绝望了,把对社会和前公司的人anger
全部都洒在我这里 |

同事在场,至少组里其他SENIOR。 跟HR 说也必须小心,不需要渲染该人所说的暗示性
骚扰,HR通常也是COVER自己的ass first |

They also mentioned they have seen cases like this so they will handle this.
People asked me whether I have sympathy for this guy or not. I want to say I
had sympathy for him. Frankly he didn't even have a bachelor's degree...If
I ever had age or degree discrimination, I probably would not even want to
talk to him (of course, there is also some other reason since it's an
internal referral). But he used up my sympathy during the interview.
I am not sure about the answer to "Does he have the experience and skills
you have or not?
But one thing I am positive about is that I don't have the attitude problem
he has. |

have lost his previous job. The guy is not tough at all. However, let HR
deal with him. I have witnessed HR laid off very tough people like a piece
of cake.
Remember, don't hire people you cannot manage. |
