i don't think a lawyer will help too much in your case. i did not get a
lawyer and won easily in the trial.

各州法律可能有区别... 从MD这里来说, 你不应该在开庭前接受租户的CHECK... 你一
旦接受了, 就表示CASE在庭外和解了... 这也是为什么租客FILE了第二个CASE...
two months fake checks是在什么时候给你的? 第一次开庭以后,还是之前?
我的建议是, 你最好是花点钱找个律师好好咨询一下... 第二次上庭, 你赢的可能性要
远低于第一次, 如果租客没有再不交租金的话...

对的,州的法律会有差别,一定要注意

The problem started as in the followig:
-In mid of April I realized that the March and April's rent checks were all
fake
-Then I sent him an eviction letter
-Then he paid me March and April rent, but $200 chekc was fake again
-Then I emailed him warning that he needed pay the $200 returned check plus
May's rent by May 10th, but he didn't pay.
-So I filed a court eviction trial, and then he paid me all the amount three
day's before the trial date
-I went to the court and told the Judge I just wanted to evict the tenant
and the tenant paid the rent before the trial date
-Because the tenant didn't appear in the court so he lost the case
automatically
- 10 days later after the trial date when the policman delivered the
eviction him
-Then he filed a new trial
-Now he hasn't pay me July's rent, it's due July 1st, and he hasn't pay
electric bill for three months already
Ah! being a landloard is so troublesome.

如果你File Eviction 的理由是 租户没交房租,而且那个是出租房,只要租客把钱全
补了,包括late Free, 按Lease的罚款, 法官一般不会判Eviction的。
Landlord出租房的目的就是为了收房租,回头房客在开庭前把欠的钱全付了,说明房客
仍然努力履行Lease的义务。
所以,做好两手准备吧,只要房客不按时付,你就去File Eviction。如果他愿意交
late Fee (希望你的Lease里有),你就权当你的辛苦fee。 吃好睡好。拿到钱就别想
其他的事了。做Landlord,就得有强大的心理抵抗力。你不是还有Deposit在手么。

真要是追究起来,我觉得你应该能赢。。。 但应该不象第一次那么简单了。。。 JU
LY没有交租金,他可以找很多理由向法官解释。。。至于UTILITY BILL
,那和房子没有关系。是租客和UTILITY 公司之间的事情。你不可能以此为理
由把租客赶出去。

估计小范围的有,大范围的,没听说。。。
做为LANDLORD在SCREEN APPLICATION的时候,一定要严抓
CREDIT。无论申请人说得多悲惨,多天花乱坠,只要CREDIT不够,一概拒
绝之。。。 与其租给CREDIT不好的,还不如直接租给SECTION8。

First of all if you are in rental business, you need to know the law well
for your area. (some county and city can have more laws on top state and
federal ones)

Read this at least 10 times until you completely understand what each one
means. (some smart tenants do and will use them against you)
If your rental contract is against the law (even if both side signed it), it
will not be valid in court.
That being said, at this moment do you really want to get rid of this tenant?
If you do, the best way is offer him some money to move out.
This is I would normally do, if the rent is due of 1st, if no pay, I will
call on 2nd, if paid with late fee, no further action, if by 3rd still no
money, I will fill with the court and offer him some cash to leave (usually
give him until the weekend or a week), if he moves out himself and nothing
is damaged, I give him cash (usually a few hundred), I keep the deposit for
the last month rent.
That is the best way (and always cheapest way) to get rid of a tenant you
don't want, the worst way is to fight him in the court and have police
enforce the court's decision. Most of the time, you will have a lot of
damage to the property and lost at least 1 month rent, and good luck
collecting if that person change job often.
But like realtor have said, check credit before you rent is the best way.

完全理解你的心情和处境。
Delaware的相关法咱不了解,在MD,如果没有solid cause, 想把Tenant Kick Out,
不是容易的,因为法律倾斜于tenant。 像楼上说的,碰到这种Tenant,有时不得不送
钱请大神走,以防大神搬走前破坏房子。有些破坏可能当时发现不了。

You would have to obtain a writ of possession from the court and present it
to the appropriate law enforcement officer. The officer then posts a notice
for the tenant on the property that the officer will return on a specified
day to remove the tenant from the property if the tenant has not moved. On
that day, if necessary, the officer may physically remove the tenant and any
other people on the property (though some jurisdictions will not enforce
the writ if, on that day, inclement weather is taking place).
Any possessions of the tenant still on the property may be turned over to
the tenant, put in storage for the tenant, placed outside the property,
seized and sold under a writ of garnishment (which the landlord would also
be required to obtain, though certain items such as personal effects are
generally exempt by law from forced sale) and/or considered abandoned,
depending on local laws. The rental property is then turned over to the
landlord.
Depending on the jurisdiction, even after eviction the landlord may still
bring suit against a tenant for "holdover rent" (i.e., rent for the period
between the date of the lawsuit and the date of actual eviction) and other
items such as unpaid utilities or property damage.
Sorry I don't know DE laws well, but can refer you to someone very good if
you fell need some help, it will cost you for sure.

I have obtained a request for possession on the 11th day after the first
trial judegement. On July 3rd there was a police man went to the property to
serve the eviction notification, and on the same day the tenant filed a
motion trial(new trial). Yesterday when the policeman went back to the
property and to check if the tenant has moved out himself. But the tenant
showed a court document to the policeman,which is the eviction is on hold
and there will be a new trial.
P.s the tenant only uses p.o.box address for all his mails.
I would like to have the lawer's contact information and to see if he can
help me.

除了要查Credit,还需要查法院记录,如果不愿花钱,你也可以到Local法院的网页上
去查,免费的Public法院记录。像你这次告的都有记录。

Rental laws are not that hard to understand, if you have time to read, you
can do this without help from lawyer.
Good lawyer cost around $400/hr, use them only after you have failed is my
suggestion.
You can also go to court and hear how other people/lawyer argue their cases,
I assume you still have some time before trail date. After you hear 20
cases, you pretty much know what to do/say in front of the same judge.

what is the fake check that you mentioned?
is the check returned because of non sufficient fund? or is it forged with
no bank account at all?
writing a large amount bad check is a felony, this can be a criminal case
and he will be in big trouble

赶租客太凄惨了
我那个租客有个律师,前面的房东和那个人打了5个月官司然后放弃赶那个租客了
我买下这个房子后和他纠缠了半天,还没上庭呢律师就收了我好几百刀,而且说这个官
司要打半年
最后我给了租客5000让他走人,然后解决了
太窝囊了!
不过我不是在DC,是在LA

这是法官陪审员的基本原则。
