We just received a tragical news that Ms. Wang, a Chinese scholar at NIBIB/
NIH, was involved in a serious traffic accident in Rockville last night.
Unfortunately, she later passed away in the Suburban Hospital where she was
taken by ambulance. There are no words right now to express our loss. We
give our deepest condolence to her family and friends.
While the accident is still being investigated by the authority, we want to
remind everyone in our community to obey traffic laws and use caution to
improve pedestrian and driving safety.

posted.

友的后事, 我不是律师，但朋友的家人全在国
内，而索赔时间有5个月之久，所以我是法定代理人。简单介绍一下我的经历，希望有
所参考。当时事故发生后，警察有一个现场记录，那个现场记录只是纪录证人的供词，
不叫警察报告，最终的警察报告5个月之后才出来， 现场记录不是很有利，因为有一个
证人说我朋友是跑步抢着过马路， 没有证人觉得司机超速，当时事现场有一些标记，
指明身体落地，眼镜落地的地点，感觉朋友似乎当时不在人行道上。事故两个星期后就
请到了一个当地的有名律师，收40%。结果这名律师几乎没做什么，感觉平均每两个星
期就和保险公司交涉一下。四个月后，保险公司赔了十万，家人最后拿到六万。再过了
一个月，警察详细的分析报告出来了，据说是资深事故分析专家，确切表明司机对事故
不符任何责任。所以你现在什么都别想，就是索赔，而且肯定能拿到一些钱，不要管当
地媒体的报道，如果有媒体采访可以在律师的建议下进行。我觉得美国的司法制度很
tricky的，期间细节我就不多说了，受害人总是能拿到一些赔偿的，找一个好的律师很
重要。我没有仔细研究你的case，我知道有的情况下如果行人责任实在太明显了的话，
可能也不好办。接下来几个星期肯定有很多律师主动找上门来(我们当时根本没找黄页
，都是朋友，老师，当地华人主动推荐的)，你要花时间interview他们，多问一些问题
，一方面长自己的知识，也可以选一个自己信任的律师，有时候律师会带你到现场，收
集证据同时也给你分析。将来你与律师的相互信任很重要。我interview过一些律师，
你如果需要建议可以和我发信。
还有几点：几乎不可能碰司机的私有财产，你要希望这个老太太保险买的金额高，更不
要想追究刑事责任，这是我们当年血的教训，如果你真想追究，可以和我联系，我可以
告诉你怎么做，但我强烈不建议。大使馆也来人了，我感觉主要是怕中国学生闹事影响
中美关系，所以一方面敦促律师与警察局长秉公处理，一方面安抚中国学生会，让人们
不要闹事。对了还有，你不会上法庭的，没到那一步保险公司估计就赔了。
版上其他一些人的建议也都很好，希望你节哀顺便，尽快进入索赔程序。
再补充一下：我感觉中国人有些思维还是和美国不一样，不是说司机有责任才赔偿的，
通过律师对保险公司进行的索赔不会影响司机的私人财产，基本不会上庭，是在正常的
法律体系下为死者争取一些抚恤金，根本不是“敲诈”。你一旦找了好的律师，就基本
上没你什么事了，偶尔去律师那签几分文件，其他法律界人士人一概不和你打交道。还
有你要做个心理准备，三个月后，地区检察官会申明司机没有刑事责任，这个也没你什
么事，和赔偿无关。 |

中国车速慢(人多快不起来),司机对行人有预期.在美国,车速快,司机在没有人行道
