H-1B is not prohibited from changing status
without leaving U.S. using I-539, but J-1/J-2
are prohibited from filing I-539.
In most cases H-1B can be valid for a max of
six years whereas J-1 prof/scholar is valid
for a max of five years (if there is funding).
J-1 has the two-year 212(e) residency requirement
(must reside in home country for two years before
being eligible for H/L/K visas; can in some cases
be waived).
J-1 prof/scholar has the two-year repeater bar
(cannot come back to U.S. as J-1 prof/scholar
for two years after exchange program terminates;
cannot be waived, don't have to spend two years
in home country).
Depending on individual circumstances, there may
also be tax treaty benefits for being in J-1 status.
Switching to H-1B (with a waiver) will generally
make the person ineligible for tax treaty benefits.
J-2 spouse is also eligible for employment whereas
H-4 spouse is not.
J-1/J-2 may also travel to Canada, Mexico, and
Caribbean islands except Cuba and return to the
U.S. using the 30-day automatic visa revalidation
regulations. H-1B/H-4 can visit Can/Mex this way
but not the Caribbean islands (will need valid
H visas to return).
