apply
for the H-1B Visa.
Risk is the same like all visa applicants: possible being denied.
However, H-1B visa applicants have far more better chances to get it than
some other visa types.

second, you are not physically in the States, so you don't have any status
in the States at the moment.
You can use your valid F-1 to enter only for the study purpose along with
valid I-20. |
