如果是早于的话，从effective date起就不能工作，不然就是out of status

If I understand correctly, the safe way will be 1. my LP File I-539 2. quit
job 3. the gap will be COS and is legal.
Another question is that
my H1b ends this Aug and needs extension. Can I file (actually my school) I-
129 together with her I-539 in June (premium), asking for her change of
status starting from June (whatever time but before my current H1B expires)?
I'm not sure if it will work because this kind of I-539 application depends
on both approved H1B (to Aug) and unapproved extension application (from Aug
). Do you think it is feasible? If yes , any suggestion on how to fill Part
3 Q2 Q3? Both Yes?
If no, shall she file two applications?
We really have no idea about this. Any input will be appreciated. |

如果要先变H-4的话，那你现在就得帮你lp file I-539，是base你现在current的H-1b
的，这个一般需要3-6个月才能批下来，不能加急，只能慢慢等，你如果6月才file的话
在8月前都批不下来，而且H-4批下来当日起你lp马上就不能工作了，不然就out of
status，这个H-4的有效期和你现在的current一样长，到7月底结束（如果在你current
的H1b结束前还没批下来，最后的结果是这个COS会被拒）
然后你在extend你的H-1b的同时再次帮你lp file一次I-539，把H-4也一起延
这样你要帮你lp file 2次I-539，处理费也要付2次，没什么必要，还不如在6月时候你
延H-1b的时候一起办了，因为你延H-1b是可以加急处理的，H-4可以同时很快批下来

比如说我打算9月11号辞职, 那么9.6号efile了转 H4,supporting document9月7号寄出
去的话.我的receiptdate是说1到10天后USCIS正式的信给了才算么?
9月11号如果是我的termination date, 那么,在那时候我还没有收到USCIS正式的
Receipt的话,我算是out of status么
我看539官方的说明说要expire45天前file, 可是谁会在45天前知道要被辞职呢? |
