2006/9 F1/F2来美,
2009/7/1-2010/6/30 OPT
2010/7/1 H1B/H4 to present
我们2010年应该可以file as resident了,因为h1b过了180天。可是在填写
8833第5项的时候看到下面这个链接的内容,
http://www.dc495.com/wiki/index.php?title=Tax_Return
第5项:Explain the treaty-based return position taken. Include a brief
summary of the facts on which it is based. Also, list the nature and amount
(or a reasonable estimate) of gross receipts, each separate gross payment,
each separate gross income item, or other item (as applicable) for which the
treaty benefit is claimed
上面给出的答案第一段是:(Your Name) is a citizen of the People's Republic of
China. He/She entered the US on (date) on an F-1 Visa (student), and has
remained in F-1 status continuously since then. Under the residency rules of
IRC 7701(b), he/she passed the substantial presence test in (year) and his
residency starting date was January 1, (year). This means that for the year
(year), he was a resident alien and he can fill form 1040 for (year) as a
resident alien.
请问我门的情况可以copy这一段吗?还是应该说我们H1B/H4过了180天所以是Resident
了?
在线等,非常感谢! | t**i 发帖数: 688 | 2 As an F-1, you can not claim resident alien (for tax purpose) yet. So you
have to use H-1b arguments.

| m******a 发帖数: 1639 | 3 Thanks a lot! but how could I make this argument? should I state: since my
husband changed his status to H1B at July 1st 2010, and it passed 180 days
now, we should be considered as Resident Alien for tax purpose.
is it ok? is there any rule that can support this argument? like any article
or regulation?
