there penalty? I ask Scottrade that one officier said they will not care.
IRS may have concern.
Any idea?

原文是“The distribution
from the Roth IRA is not a qualified distribution. The portion of the
distribution allocable to earnings may be subject to ‘tax’ and ‘it’ may
be subject to the 10% ‘additional tax’.”
的那个‘it’指的是“the distribution”,也就是总共的withdrawal,要交10%的‘additional tax’(或者说是early withdrawal penalty)。
“What Are Qualified Distributions?
A qualified distribution is any payment or distribution from your Roth IRA
that meets the following requirements.
1. It is made after the 5-year period beginning with the first taxable year
for which a contribution was made to a Roth IRA set up for your benefit, AND
2. The payment or distribution is:
a. Made on or after the date you reach age 59 1/2,
b. Made because you are disabled,
c. Made to a beneficiary or to your estate after your death, or
d. One that meets the requirements listed under First home under Exceptions
in chapter 1 (up to a $10,000 lifetime limit).”

distribution,里面的code会说是subject to 10% early withdrawal penalty,然后

Regular contributions.
Conversion and rollover contributions, on a first-in first-out basis
(generally, total conversions and rollovers from the earliest year
first). See Aggregation (grouping and adding) rules, later. Take these
conversion and rollover contributions into account as follows:
Taxable portion (the amount required to be included in gross income
because of the conversion or rollover) first, and then the
Nontaxable portion.
Earnings on contributions.
accounting

please read pub 590 http://www.irs.gov/pub/irs-pdf/p590.pdf carefully,
especially following pieces:
pg65 - Are Distributions Taxable?
You generally do not include in your gross income qualified
distributions or distributions that are a *return of your regular
contributions* from your Roth IRA(s).
which part of distribution is subject to tax & penalty? in early
withdraw situation, it is NOT a qualified distribution, so:
pg66 - Figure 2-1. Is the Distribution From Your Roth IRA a Qualified
Distribution?
The distribution from the Roth IRA is not a qualified distribution. The
portion of the distribution *allocable to earnings* may be subject to
tax and it may be subject to the 10% additional tax.
further more on penalty:
pg67 - Other early distributions
Unless one of the exceptions listed below applies, you must pay the 10%
additional tax on the *taxable part* of any distributions that are not
qualified the year together.
