Ex-CME Group Programmer Pleads Guilty to Stealing Trade Secrets

A former computer programmer for CME Group Inc. CME -1.16% on Wednesday
pleaded guilty to charges that he stole information from the futures
exchange operator while pursuing plans to improve a trading platform in
China.
Chunlai Yang, a senior software engineer who worked at CME for 11 years,
pleaded guilty to two counts of stealing trade secrets, according to the
plea agreement disclosed by the U.S. attorney's office for the Northern
District of Illinois.
Mr. Yang has been free on bail since his arrest in July 2011 and faces a
maximum penalty of 10 years in prison and a $250,000 fine for each of the
counts.
The U.S. district attorney said in a statement that his plea agreement
contemplates a term of 70 to 87 months in prison, with sentencing due on Feb
. 20, 2013.
CME declined to comment.
Mr. Yang, 49 years old and a Chinese national with U.S. citizenship, was
arraigned on the charges last year following an investigation by the Federal
Bureau of Investigation. CME began closely monitoring his computer activity
in early May 2011, according to the complaint filed against him.
According to the plea deal, Mr. Yang started working on technology powering
CME's front-end trading systems in 2000 and was a senior software engineer
at the time of his arrest. He admitted to downloading more than 10,000 files
from CME computers, and planned to offer improved technology to the
Zhangjiagang Exchange.
The case highlights the critical importance of computer code to trading
operations and is the latest in a series of hard-fought legal cases over
alleged theft.
Sergey Aleynikov, a former computer programmer for Goldman Sachs Group Inc.,
GS -0.72% was found guilty in December 2010 of stealing algorithmic trading
code from the bank ahead of his departure to join a new high-frequency

so most companies donot care where you keep the code. but u cannot sell the
code for sure.
