定一下之后找
工作 转industry H1B， 需不需要4月份申请，等到10月份在工作呢？到底academia
H1B有什么好

在学校里就申请绿卡。一旦你拿到了绿卡，以后找工作就容易多了。
至于转profit H1b，还是要等那个4月到10月的空档的，所以没什么太大的意义

等到10月，譬如说，你8月份申请了，马上就可以工作，这个是H1B portability. 但你
中间不能有GAP，即你8月份申请的时候，你现在的H1B还是有效的。

I can give a link. I think what I said is valid based on the may 2007 letter
regarding h1b portability issued by USCIS. you can find the letter using
google.
I was also confused and asked the question on this board but got just one
answer: this is a standard practice.
It seems that many postdocs are just unaware of this new rule.

发帖数: 156 | 12 怎么才能确保none profit的H1b有效呢，都离开学校了，难道学校里还会给你保留签证？须知，H1不像J1可以转成不发工资的visiting scholar，停薪即为终止。看到job版上曾经有几个人问这个问题，但是对方公司死活不同意，认为可能有潜在的让公司非法雇工的危险。最后不知道argue成功了没。 |

这里面根本就没有所谓的转H1B，因为profit 和 nono-profit的H1B根本就不是一回事

仔细读读，实际上的操作性几乎为零，当你结束你所在非盈利性机构组织时，你的non-
profit H1B会
被 terminate并且通知USCIS，也就是说下面的一条不可能成立 “s/he must
otherwise be
eligible for an extension of status, with no "break" in the I-94 validity
period prior to October 1, 2007. That is, in the example, the I-94 with
employer A would need to extend at least until the requested October 1,
2007 start date with employer B." 而且大部分的顾主B也不会冒险让你在你的工作
签证生效
前开始工作。
