Immigrants Act (S.386). I appreciate your taking the time to share your
views with me.
In February 2019, Senator Mike Lee (R-UT) introduced S.386. This
legislation would eliminate the seven percent per-country cap for employment
-based immigrant visas without increasing the total number of visas issued.
S.386 was referred to the Senate Judiciary Committee, of which I am a
member. This bill is a companion measure to legislation (H.R. 1044)
introduced and passed in the House of Representatives.
I appreciate your thoughtful comments. While some believe this legislation
would prevent immigrants from being penalized due to their country of origin
, I have concerns that S.386 would unfairly shift immigrants from small
countries into the backlog and allow a few large countries to dominate the
immigration process. Please be assured I will keep your thoughts in mind
should S.386 or its companion legislation come before the full committee
this year.

Please vote AGAINST High-Skilled Immigrants Act (H.R. 1044, S. 386) .
Contrary to its name, The Fairness for High-Skilled Immigrants Act is
anything but fair. Currently, no country’s nationals can comprise more than
7 percent of any visa category. These caps lead to diversity in employment-
based immigration, which reflects the long standing American priority of
welcoming talented immigrants from across the globe.
If this bill passes, nationals from other countries need not bother applying
for employment-based visas. They would be completely shut out from the
process due to the overwhelming number of Indian petitions. Indian would
monopolize an entire immigration category. If passed , Indian will flood
into US employment market by millions in years, by further abusing H1B
system. Right now , most of the H1B visas go to those Indian outsourcing
companies, by cheating . Please stop H1B abuse by Indian outsourcing

In contrast, this bill goes against principle of fairness in diversity by
eliminating per country caps and will only favor certain countries with the
most number of applicants, particularly China and India. This will greatly
reduce the number of immigrants from other countries with less applicants. A
much skewed immigrant composition will hurt America as a leader in
recruiting talents from a diverse ethnic and national background in the long
term.
