$20M suit by kin of ex-con slain by cops
The mother of an ex-con fatally shot in a battle with police has filed a $20
million lawsuit against the city and the NYPD sergeant who was wounded by
friendly fire.
Denise Elliott-Owens had two sons who were killed by cops in shootings that
were deemed by authorities to be justifiable deadly force -- and this is her
second lawsuit against the NYPD.
Naim Owens, 22, was on parole for a gun conviction on Aug. 31, 2014 when he
exchanged gunfire with cops in Bedford Stuyvesant.
A law enforcement source said a surveillance video showed Owens firing at
police officers and a gun was recovered. He was hit in the back and died one
week later due to complications from surgery.
"An investigation determined that this was a justifiable shooting and no
grand jury action was warranted," said a spokeswoman for the Brooklyn
District Attorney's office.
Sergeant John Hirschberger, who was grazed in the leg by a police round, is
named as a defendant in the suit.
A lawsuit on behalf of Naim's then-18-year-old brother Khiel Coppin, who was
shot 13 times after he told police he had a gun and then pulled out a
hairbrush instead, is still pending in Brooklyn Supreme Court |
