标 题: 华人进步与平等协会(CAPE)将尽一切努力阻止SCA5

加州参议院于一月三十日投票通过了加州宪法修正案CA SCA5。修改后的加州宪法将允
许公立大学录取中进行种族，性别，肤色，出生国别的歧视。这一法案被称为1964年人
权法案以来最为种族歧视的立法案。
这一法案明目张胆地把种族与性别歧视写入加州宪法，剥夺公民平等受教育的权力，从
根本上是违背美国宪法精神的。
我们认为，消灭对少数族裔歧视最有效的办法是彻底地禁止种族歧视，而不是在公立大
学里实施歧视性的录取政策。
为此，华人进步与平等协会作出以下声明：
1. 我们将团结所有反对SCA5和愿意参与其他华人平权活动的朋友。请登录我们的网

2. 我们将尽所有努力，通过各种方式，包括诉讼途径，在阻止SCA5提案上帮助加州

That Section 31 of Article I thereof is amended to read:
SEC.31. (a) The Stae shall not discriminate against, or grant preferential
treatment to, any individual or group on the basis of race, sex, color,
ethnicity, or national origin in the operation of public employment, public
education, or public contracting.
The California Senate's supermajority vote on Jan 31 to pass the SCA5 bill
is a shame of the Californians, as well as the Americans. It is unbelievable
such outrageous discrimination can be written into law and practiced in the
education system in American today, where the notion of equality is
instilled into almost everywhere else, no matter it is about employment,
housing or services.
The SCA5 bill is openly and specifically discrimination based on race, sex,
color, ethnicity and national origin. It is by far the most racist bill
introduced in a State legislature since the 1964 Civil Rights Act.
It is simply unconstitutional.
We believe, the best way to stop racial discrimination is to stop
discriminating on the basis of race, EVERYWHERE, particularly in our public
education system.
We at CAPE is determined to fight against SCA5 with all means to the end:
1. We will unite all people who are willing to fight together with us.

目前，加州众议院的80席中，有55席民主党，25席共和党。对这个法案的支持，党派分
明：民主党同意而共和党反对。通过这个法案，需要54票。我们只需要保证 2 个以上
民主党议员勇敢地站出来，投票反对，我们就可以让法案胎死腹中。

this matter before pushing ahead with this drive.
The SCA5's new text reads:
SEC. 31. (a) The State shall not discriminate against, or
grant preferential treatment to, any individual or group on the basis
of race, sex, color, ethnicity, or national origin in the operation
of public employment, public education, or public contracting.
(b) Notwithstanding subdivision (a), this section does not prevent
state institutions of higher education from implementing student
recruitment and selection programs that are permissible under the
equal protection clause of the Fourteenth Amendment to the United
States Constitution.
Part b is the new portion. And it clearly states whatever program the
educational institution implement would have to be permissible under 14th
Amendment. It also doesn't mandate such program to be implemented.
So it's pointless to argue SCA5 is unconstitutional based on how it's
written, because the wording of the law define it to have to adhere to US
constitution. That's why it passed through California congress so easily.
Because although you can interpret the motive of the person proposing this
law to be discriminatory, you can't argue with the actual language.
It's only when the universities, colleges and such actually implement a
policy under SCA5 that you can argue whether that the particular
implementation is unconstitutional. | M****7
