Close of escrow to be concurrent with sellers purchase. Occupancy to be
COE + 2 Days (5:00 pm). Escrow to be XXX. Title to be YYY.
Home inspection to be performed within 9 calendar days of Acceptance.
Appraisal to be ordered within 9 business days of Acceptance.
Contingencies (including loan) to be removed within 17 days of Acceptance.
然后在C.A.R Form COP上选了"Seller's purchase of replacement property"
Seller shall, within 19 days after Acceptance, remove this contingency or
cancel the Agreement. If Seller does not remove this contingency in
writing within that time, Buyer, after giving Seller a Notice to Seller to
Perform(CAR. Form NSP), may cancel the Agreement in writing.
请问我作为买家,这样的条款可以接受么?我的理解是过了19天之后,没有了Purchase
of
replacement property的contingency,就可以按正常的escrow的程序走,不会出现托很
久的情

a big issues since you can not control that if you have to apply a loan and
the lender will not work on seller's time frame. all others shouldn't be a
big deal.

这个appraisal是lender在批了我们的贷款以后order的么,还是可以先order?
如果他同意可以先order是不是就没有问题了?

lender needs do two things before saying yes to you. One is checking on you
to make sure that you are qualified. 2nd is checking on the property to make
sure the loan to value ratio is fall into their requirement. Typically the
lender will not work on your order. By the way, you don't have to agree on
this with the seller. just tell them that you have no control on this. Also,
if the seller can not get his new house closed, you will not get this one
either. so even you have done all these, you still may not be able to get
this house.
