apartment一侧有一节空档楼梯，直
接一脚踩空，然后迎面骨头磕碰前面的阶梯，大量出血；最后没办法下午回来之后2点
多去了医院，周六看了急症，拍摄了
X—RAY说骨头没事，就是破了，皮外伤口有点严重。
不知道这个房东的过失大不？因为是那节楼梯师兄说一年前就用木头顶着，现在已经完
全空了。但是也是自己走快了，才踏
进了空档，血流不止。
这个我应该和房东argue下么？
本人第一年新生，才来美国一个多月，如果上court argue， 怕之后会不会被房东报复？
看看那位大牛给些指点。 |

liability. what are you afraid of? |

I look through the contract with my Landlord, there are all the
responsiblity on my side but no liability on him; and he is not liable for
any loss of property of the tenant since that kind of insurance is not paid
by him.
What can support me for set up such issue?
The legal counsel told me that I can set up only a small claim. |

covered by the tenant's renter's insurance. the contract is probably
irrelevant here.
if you have a lawyer, he may well be right. your claim may not be too big (
i would guess several thousand to slightly more than 10 thousand). still,
you should get compensation. maybe you can try to settle with your landlord
for an amount you are satisfied with. if a settlement can't be reached,
you can sue the landlord. |

SMALL
CLAIM MYSELF WITH NO LAWYER ALONG WITH ME, THAT WAY I CAN GET THE FEE FOR
THE
MEDICAL BACK, LIKE 800 BUCKS IN TOTAL FOR THE EMERGENCY AND X-RAY.
I JUST WONDER WHETHER 10,000 IS REALLY THAT REASONABLE FOR MY CASE, SINCE MY
BONE
IS OK, AND NOW, MY WOOD IS GOING TO RECOVER, PROBABLY IN A WEEK.
