1是change of status，这个你必须带到H1B生效
2 要求境外激活
你申请H1B的时候选的哪个 |

在你的H1B(和change of status)被批准之后，
你可以出境并持有效的F1 VISA（非Cap-Gap）在10月1号之前入境，并且不会影响你的
H1B身份(last-action rule)。
如果你要在10.1之后入境，那么必须申请H1B签证入境。
具体以公司律师的意见/建议为准。 |

unexpired EAD issued for post-completion OPT and who is otherwise admissible
may return to the United States to resume employment after a temporary
absence. By definition, however, the EAD of an F-1 student covered under a
cap gap extension is necessarily expired. As a result, if the student elects
to travel outside the United States during a cap gap extension, he/she
should be prepared to apply for an H-1B visa at a consular post abroad prior
to returning. As the H-1B petition is presumably for an October 1 or later
start date, the student should be prepared to adjust his/her travel plans,
accordingly."
What I understanding is If my school issued me cap gap I-20 with my H1b
receipt, so my EAD of F-1 student would be automatically expired, no matter
my post OPT is still not finished yet.
Am I right? |

recognized by CBP, you cap gap extended I-20 date is not good for reentry
according to ICE policy. |

没问题的可以顺利回来 当然你的F1和EAD必须有效 另外HR也帮我问了USCIS答复也是如
此：
Once you receive your Approval Notice, you can travel outside the United
States. You must have the Approval Notice with you while traveling. 至于F1
签证过期的，只要是重签我觉得就有风险。cap-gap老老实实呆美国等10/1

have my OPT valid till next year.
They know nothing. I only asked for a signature for travelling aboard. And
then they just issued me a cap gap i20 |
