10月底提交H1B申请。今天给学校写邮件问起Cap Gap的事情，不料竟然被告知：
Please send me proof of the H1B filing right away. SEVIS has misapplied
the
Cap Gap in your situation and has actually SHORTENED your OPT in SEVIS
incorrectly to 09/30/2011. I need this information so that I can contact
the
SEVIS Help Desk to get this corrected.
请问这是谁的疏忽？结果很严重么？会不会拖延H1B审批的时间？今天我公司的主管还
问起这个事情。我不想由于H1B pending而无法上班，是不是必须要办加急了？

you can work using OPT before H1 approval(or until Feb, if H1 will still be
pending then) |

I actually called my lawyer today and was told that I am ELIGIBLE to work
until my h1b gets approved, regardless of the dates.

Your case is NOT cap gap because H1 filed after Oct 1,2011
If mistakenly considered as cap gap, your school might have terminated your
OPT on Oct 1, 2011. (cap gap is between Apr 1, 2011 and Sept 30, 2011) so
cap-gap OPT automatic extension ended on Oct 1, 2011. |
